You can't use a college players name or likeness to make money off of products or services. Though I think there's something going down now about business' that donate to, for example UT being able to use a current player for advertisements.

Yet, they can put up a big billboard on I-40 trying to sell tickets with current players.

Actually eastbay offers fully customized jerseys with names on the back. Since berry's number changes to 10 and I'm pretty sure the people running the orders don't know that so you should be good to go.
