If a male is too drunk to consent to sex, and a female or another male has sex with that drunk male, then the drunk male has also been raped.
If both parties are too drunk to consent to sex, then they have both raped each other. In such a case, I doubt either party will want to press charges, given that both parties are victims and perps.
This has to be one of the dumbest things I have ever read..do not get me wrong, I am not calling you dumb personally. I am saying your understanding of what is rape is dumb.
If you get a woman so drunk that she passes out, then you have sex with her
..that is rape, you forced yourself on someone who was not in a position to make a choice on the matter.
Just because someone drinks, it does not mean they are not responsible for their own decisions..I.E. going to bed with another person
We do not let drunk people off when they decide to get in a car after drinking and end up killing someone on the roadways..because they made the decision to drive.
So how can you be responsible for deciding to drive, but not to have sex. It makes no sense whatsoever. You can not have it both ways.
Still wanting to hear opinions about a reverse argument. What if both parties are drunk and the female initiates the contact? What if he says no, but can't control his arousal, and she mounts him anyway? Has she raped him?

To me, Rape is when the woman is attacked and forcibly penetrated. They ought to come up with a new name for whatever this she said / he said / too drunk thing as it's an insult to women who were raped.
It might be good for the university if Drae Bowles explained, once again, that he was not beaten up. We also might want the Lady Vols to be allowed to discuss "rape culture" to the media. The university is probably telling people not to say anything to avoid feeding the story. But with the rehash of the Peyton Manning trainer incident, there is going to be lots of attention on this lawsuit anyway.
The Mack Crowder story would have gone away quicker if he had been allowed to say it didn't happen. I believe they told his family not to talk about it.

Rape is a form of sexual misconduct. Thanks to Title IX, UT is in the business of enforcing the law.
I have no idea what you're talking about. I am just making fun of how people view this a big deal. I assume that the university gets that rape is bad and I am sure they follow the law to make sure women aren't raped. I assume this for every university besides fsu.
I could care less what the laws are, I simply know that the university prolly knows and I'm sure they comply with whatever they are supposed to do. This is a money grab at best and lawyers are always the winners.
It could be considered a big deal since Title IX says TN state law is creating a culture of rape at UT.
The law suit is saying that the State of TN takes these accusations too serious by allowing an accused to have a lawyer.
I understand I should care. I choose not to because I view it as stupid. I am ending this because I don't care. Its a money grab those attorneys are loving it. Im suing America because they let us have guns and people get shot.
