I think it should be perfectly fine, however, I also believe that the opposite should also be legal: employers should be able to keep from hiring people that are not overweight or that do not smoke.

Of course, both practices would be lousy ways to run a business, but there is no law against running your business into the ground.

I think if you are overweight or smoke, getting discriminated against is just part of the deal whether people mean to or not.
