. . . against employees (prospective or current) because of their weight or because they smoke? In other words, is it okay for an employer to choose not to employ one of those two types of people?

I think it should be perfectly fine, however, I also believe that the opposite should also be legal: employers should be able to keep from hiring people that are not overweight or that do not smoke.

Of course, both practices would be lousy ways to run a business, but there is no law against running your business into the ground.

I think if you are overweight or smoke, getting discriminated against is just part of the deal whether people mean to or not.
