Charges have not been dropped

The official police report states that he came out of the store. Are the witnesses changing their story?

All eyewitness testimony is notoriously unreliable. The tape will govern if it exists.

If I were the defense counsel on this, I would be licking my chops to cross-examine those two Gomers from Cosby.

I am equally sure the DA is considering the credibility of these two yay-hoos as his star witnesses before charging the case formally.

I don't know. The article gave the name of the police spokesperson. Maybe it's one of those "after further review" (sorry) stories.

Hmmm. The victims report to the cops that two men with hoodies and a gun try to rob them and leave in a blue Prius with a 3rd man who told them it was time to leave and a female driver.

A short while later, police find exactly what they are looking for. Car, occupants, hoodies and gun and some drugs to boot.

I'm sorry...where is the credibility issue you allege. You don't seriously think these guys were set up.

Eyewitness testimony.
Victim testimony.

All 3 are liable. Even if JJ was not at the scene but knew what happened and did not report he is just a guilty. Will he serve time? NO. The DA will use his testimony to convict the other 2. I deal with it daily. He was ROR because the Night Court Comm. did not see that JJ was a danger to the public and he would return on his court date. The other 2 the Night Court Comm. felt they were a danger to the public, would not return and since Robbery or even Att. Robbery carries a mandatory prison sentence if convicted he cannot let them out.
People keep saying it was just a BB gun. The law only requires the victim to assume it is a real gun. If the victim feels the gun was real it is now a real gun.
I see this case being pled down to Agg. Assault with no jail time and probation unless the Knox Co. DA wants to make an example and not take a plea so it will go to a jury trial. With the back log in courts that could be 1-2 years.
My prayers go out to the young men. I hope they can recover and become a productive part of society. God Speed.

They all need to go. We don't need to go back to winning the Fulmer Cup. Kiffin is cleaning this thing up and he needs to get rid of them to send a message that we will not put up with this kind of crap.

I am sick over this happenning - It hurts our team, our future in recruiting, and has been a torpedo at the waterline for all of the positive media attention we have been getting.

BUT - The most important thing here is the four kids involved and making the consequences for this so severe that they don't do it again. I would love for JJ to play Saturday, but if that happens I would be more afraid that he would be right back in this situation within the year - and guess what - He would expect to be bailed out once again - until he ended up in real prison like Maurice Clarett.

So - IMO the minimum is :
- suspensions for the rest of the season
- the harshest internal punishments they have ever seen.
- The hoodie guy with the gun - Gone once proven.
- The other hoodie guy - Suspended til 2010 season.
- JJ - Dangle the bowl game as a carrot for future good behavior.

I think you are being too lenient. Anyone involved should be gone, permanently. If JJ really was innocent, maybe let him back on eventually, but barring some new information that saves them, the other 2 guys should be gone, period.

You could be right. My reasoning is that if they stay involved with the program you can continue to discipline them.

Once you cut them loose they migrate back to whatever enabling bunch they came from and all they hear is how they were "unfairly mistreated". Thus if any of them have potential to rehabilitate (key point) - I say keep 'em.

The two that were involved in the robbery should be expelled and gone, once proven guilty, no questions asked.

JJ should not play until next season even if he is cleared, just for being involved in it.....and you cant tell me he didnt know anything about it.
