In today's legal climate there is a reason for that.

Since plea bargains became so commonplace, past charges are recorded so if a pattern emerges of being charged multiple times, investigators and prosecutors then know it's time to dig deeper.

In order to get it expunged, you might have to show the complainant or a witness lied, or evidence was very questionable.

I don't like the practice. I like plea bargains less. I prefer proof beyond a reasonable doubt. But in an imperfect world with an imperfect system, you have to do something so repeat offenders with slick attorneys will respect the laws, and not just twist them to their advantage.

To be clear, ANY charge that is dismissed or that someone is found not guilty of is automatically eligible to be expunged. You just have to file the paperwork, which many fail to do.

There are probably other facts/issues that we may not be privy to that have an impact on reinstatement. It could be from a number of sources: maybe the higher-ups have some issues; maybe there's some other legal issues pending; could be a myriad of reasons why things are held up. Especially when it comes to personal privacy of an individual they can't release info for a lot of things. Just saying....:unsure:

I see what you're saying, but it's all speculation. What we know for sure is that he was accused 6 months ago, was pretty much exonerated by the authorities 4 months ago, and still sits today indefinitely suspended. At what point does the kid, who's now been cleared, get his life back?

Alexis situation: lets clear this up. He was not found innocent. He was not vindicated either. A deferred prosecution usually means you are guilty, but if you straighten up and fly right, you will not be punished for your crime. His deferred prosecution runs in October. In October he will NOT be found not guilty but instead the charges will no longer remain. This has nothing to do with innocence or guilt. It is a way to get lesser crimes off the courts docket.

I think it's possible that we do not see his return until October after nothing is still hanging over his head.

Is he still in school?
Is he still on scholarship?
Is he living in Knoxville?
In the dorm or off campus?

These answers should give an indicator regarding his future....so anybody know anything?

I may be wrong here so will someone with solid info please clarify.

I thought I read somewhere that 1 charge was completely dropped and that a 2nd charge was reduced to a misdemeanor.

The reduction to a misdemeanor charge was agreed to by the lady that make the accusations, probably to keep her name out of the records, and that the 6 month period to stay out of trouble for the player was a part of the agreement to the 2nd reduced charge of a misdemeanor.

Only because the 2nd charge was reduced to a plea bargained misdemeanor is the reason he's serving a 6 month probation but if both charges had been dropped I doubt the DA's office would have imposed a probation period.

He may still return this season and maybe play some or it may already be agreed upon that he'll redshirt this season.

buTch will let us know when he decides it's a appropriate time.

From the university's standpoint the important thing to consider is that the facts of the case aren't in question. He isn't legally accountable if he keeps his nose clean, but that doesn't mean the AD wants to put him in the public eye with the university's name on his chest.

You're parsing words. The kid has been "cleared" and there's no reason now to not let him join his brothers and play football which is the reason he's in Knoxville. Say it how ever you want, but the only impediment remaining for him is Butch, and he needs to stop screwing around with this kid IMO.

He's been in school taking classes since January. I've heard that several times, the latest being this morning from Doug Mathews.

It's really a very simple process though to get a charge expunged if it's been dismissed without prejudice.

And Treyvon Paulk was never even charged, but Butch decided he did not live up to the standard he expected his players to uphold. If that's his decision here as well, then I will respect that. Football isn't everything, particularly when someone gets arrested within a month of being on campus.

IF he is reinstated, and I believe that is a big IF, then I wouldn't expect to see him this year at all because he hasn't been in the strength and conditioning program at all and certainly won't be in any sort of football shape. Best case, he redshirts this season and gets back on the field for spring as a redshirt junior with two years to play.

It could be that Butch has placed conditions beyond the charges being dropped on him that we aren't aware of.

I think CBJ put him on 6 months probation. If nothing changes he will suit up in Oct.
