Give it up. I tried that argument a few weeks ago and never got a response. Even bumped it 3 or 4 times to jog his memory. Nothing. He doesn't like to follow lines of reasoning that will end up destroying his flimsy arguments.

A fallback would be to defer to the SEC - the one in Birmingham - for a solution.
