I would have no problem with them adding a mental health component to the checks.
Yes it should but just like with guns if you harm another person or their property the penalties should be extremely stiff.

Let's say yes. It should be.
What does that mean to the millions that do it? Just like the millions that disregard speed limits. The law is not preventing it. It just sets the guidelines for what happens if you get caught or harm someone doing it.
If you think it doesn't, then your are crazy.
I know several people that avoid it specifically because of drug testing at their place of employment.
