So if you tie a rope around your neck and cut off all circulation and you cease to live, it doesn't prove that you were a living organism?
A fetus does not have to be a living organism to utilize oxygen. The tissues in my arm utilize the oxygen that is transferred to those tissues from oxygenated red blood cells. My arm is not a living organism.
The argument must be made that distinguishes how the fetus is "living" from that of the other tissues in the body. The argument must be made that distinguishes the difference between the living of the spermatozoon and the living of the fetus.
When you say it is alive so it must be protected, you are distinguishing that certain sort of "alive" from the "alive" that the tissues in my arm are. So, if your argument then rests on the sort of "alive" that the tissues in my arm are, then you do not, in any manner, support you main position: the fetus ought to be protected.
Good Lord man you just made the most pathetic, illogical analogy I have ever seen. Comparing an arm to a fetus? You just failed on a massive scale.

I understand the parents were not helpful but Jesus I can understand how they'd be upset in this case. Seems like a Catch-22.
I also have a problem with the judge determining what medical condition the child has. The judge is not qualified to make this assessment and there are conflicting diagnoses. By siding with the Children's diagnosis the judge biases him/her self to see the claim of medical abuse by Children's.
