If the Thamel report is true, I suspect Duke will enforce the contract and would not blame them for doing so. I do wonder if these kids even read or are given a summary from agents of what they sign. I’m not sure why Mensah would shop around if he knows his exclusive rights belong to Duke, but I guess this Wild West we are in is giving the student athlete the impression their power is unlimited.

Lame truly understands that the NCAA is ball less toothless tiger. Besides rules for people with no integrity are meaningless. The laws of the universe can not be broken. Lame will end badly, you can count on it. He will join the long list of people who thought they were gaming the system and the system ends up gaming them.
 
so basically we could pay Mensah all through third party NIL sponsorships and be ok. just can't give him any of the school-funded rev share dollars unless Duke lets him out (which is code for a buyout). honestly, the timing of this move suggests more of UT being a player than Miami. Miami doesn't need the benefit of this timing because it doesnt have good young Qbs to scare away. We do. If he's entering for us, this is very well orchestrated because it keeps GMac in the boat due to the timing.
I would be totally shocked if it is us and not Miami. I am not saying our lawyers won't look it all over, but you don't send gmac on a press junket with all our recievers and have DW make a cheating speech to then spend 12 mill on Mensah. Jmo
 
IF (big "IF") we got Mensah, this forum would be BOOMing for days, all heupel's sins would be forgiven, and the sky would no longer be falling. Then we would immediately start talking about who we will be playing in the first round of the playoffs... This forum is an absolute rollercoaster of toxic emotions. I LOVE IT.
 
Something is odd about the wording here. In the first post, he says that Duke has exclusivity on his NIL. In the second post he says that nobody but Duke can pay him Rev Sharing.

I think this is probably not going to end up being correct.

Duke can use Revenue sharing for his NIL, but they could not have signed that contract a year ago. Prior to House, schools could not contract or pay players directly, NIL or otherwise.

Before House was finalized and the NCAA released the guidelines, only third party NIL was allowed. House granted the schools the ability to share revenue with players up to a cap. Schools can now pay players for their NIL (though it is not required for revenue sharing), but this does count against the schools rev sharing cap.

So I am curious how Duke signed a two year deal to pay him from Rev Sharing for exclusive NIL rights that is now in its second year when a year ago, Duke was not allowed to sign a contract with any player.

Edited to say - they may be stretching the concept of "in the second year of the deal".

Supposedly, Duke's NIL holds his NIL rights. So not quite as cut and dry.
