I understand your going off precedent and your right to do so that how the system operates..but it's not how the system was designed. It been ereoded over the years..basically the courts have hard line on entry to the home because of the 4th....but allow the detention because it easier. This ignoring the 4th for that particular action. I think and I may be wrong, he is asking why it not consistent?? As it was written..so either both require a judicial warrant for immigration or neither should. Does that make sense ??

Even funnier if you go down the list of the BOR the court have done this with everyone....instead of a all or nothing BOR as was intended the courts have chipped away at the edges (allowing detention ) while maintaining the core (home entry) while technically they are both protected.
 
No you’re just ignoring that case and extrapolating that ICE can go wherever they want. I’ve never argued they can’t detain if the individual is engaged in areas where they have authority to engage them.
So where is actual evidence that ICE broke into someone's home without exigent circumstances?

But your definition of forced entry doesn’t include this.
Weird that the door has no damage and the only actual "evidence" of this is the man himself...Not only that but the protestors there filming didn't catch this "breaking in" either/?

I posted about violations this summer. Guess what? Nobody cares. They pretend like it's not happening, then when it is proven to be happening, they try to say it's something else slightly more acceptable, but ultimately they don't care because it's not happening to conservative whites in Lenoir City and yhey never cared about the constitution, it's just a sometimes useful rag for their tribe.

Question on the subject of administrative warrants, criminal warrants and probable cause. LE gets a tremendous amount of leeway in violating the 4th when they claim probable cause. So is it reasonable for ICE to claim probable cause when someone won’t open a door or shuts a door in their face?

How about when they have an administrative warrant and see the person go into a house can they go in after that person since they have probable cause to believe that person is in there?
This falls under exigent circumstances and allows it.

That's why most of these drama queens won't post actual evidence of ICE's forced entries because the few times it HAS happened has been in pursuit of a criminal who ran inside a home or business

There are multiple exceptions for a warrantless search that are used by law enforcement every day. This includes persons, belongings, residences, vehicles and more.

It helps if you ever have actually studied law and been IN law enforcement

You have ONE guy who was the "victim" saying they "forced their way in"...nothing about breaking down the door (which is completely fine in the picture). Nothing filmed showing this by the protestors there.

Considering the amount of provable lies from the anti-ICE people, (just like with the 5 year old incident) I need a little more than "trust me bro it happened" with literally NO evidence.

The media article frames it as ICE broke down the closed door and made their way in, his statement can be interpreted as the door was open and they forced their way in past my daughter. OR it could be completely made up and they simply walked into the home "uninvited".. I need some actual evidence to properly make a call on the legality.

It said the door was forced open. Yeah I know “but it wasn’t broken it says forced”. GTFO with that parsing when they are told no without a warrant they can’t force their way in and drag the guy out of bed. Oh BTW the guy was a US citizen and they had to let him go. 🤡

Oh I know the citizen part, they were there because the guy's son was driving a car whose owner had the same exact name as an illegal sex offender they were looking for; (that guy was in jail for yet another assault at the time but MPD wouldn't share that information with them, and refuses to make illegal detainers public so this whole incident could've been easily avoided to begin with)

Also he claimed they "forced their way" into the house so the door could have been open, which again isn't evidence that ICE is "breaking into people's homes and busting doors down" which was the initial evidence I asked to see.

You’ll also find a way to justify any over reach by law enforcement. We can all see it.

So how thick was the complaint folder people filed against you over the years? Yes I know you’ll say it doesn’t exist. But if you acted on the job like you bluster here I simply don’t believe you.
