I am assuming with letters, and possible texts and emails, those would require a warrant to obtain.

and as a lay person the general difference seems to be that a subpoena requires the subject to provide specific "information", while a warrant allows the government to go seize whatever is covered.
I think the first paragraph is correct.

Tennessee has a statute (40-17-123) that covers these subpoenas. They have to be issued by a judge and there is a quantum of suspicion requirement (reasonable basis, which is vague).

Very brief search for the 6th circuit and Tennessee cases for use of that statute to obtain text messages turned up a small number of cases and nothing really on point. Usually that’s a sign that law enforcement just knows better.

I think the subpoena and warrant work basically the same way, it’s just a matter of what it can be used for. The more invasive the search or the more inherently private/protected the information tends towards needing a warrant. In this case, because it’s being obtained from a third party, it is less invasive and because it doesn’t involve the contents of communications it was arguably not protected.

So you’re going to start with the assumption that spying on your political opponents is warranted? This should always require a large amount of evidence and be heavily scrutinized

I don’t think I’ve ever weighed in on anything recently with Comey, but as far as I’m concerned present any evidence on Comey and let’s see where it falls. If it’s a big nothing burger then obviously Trump is using the DOJ for retribution. Present the evidence.

Same in this case. If it’s true there were investigations, present the cause (if there is one) and any findings before judgement is passed. Assuming everything is politically motivated is a mistake, especially when it can objectively be proven or disproven.

I don’t like the Comey investigation, but I also opposed investigations into Trump and the senators listed in the thread.

Am I mistaken or are you only opposed to the Comey investigation?
