You're conflating legal cases. That government post was related to the asylum hearing. The order isn’t final. There is another appeal to BIA. He also has civil proceedings in federal court pending. Those are now on hold due to government shutdown by the GOP. He’s still detained but not being deported until those proceedings are concluded.

The civil legal case - which may or may not find the US engaged in vindictive prosecution (they did) - is unresolved. The entire process has been retaliatory (obviously) and a judge could prevent deportation by dismissing charges and issuing protective orders.

Ironically, the words of Trump's own goons may enable Garcia to become a free man and walk US streets again.
