she wasn't denied. the family didn't seek one and the article suggests she MAY not have been able to get one in Miss but that the law allowed for it.

But amid confusion over what abortion care is allowed in Mississippi, Regina says she was unaware Ashley qualified for an abortion in Mississippi under the law's exception for cases of rape. Yet, even if she was aware, it's unlikely Ashley would have been able to get an abortion in Mississippi; with heavy restrictions in effect and the high penalties on physicians who violate the abortion ban, it is unlikely she would have found a doctor willing to perform a procedure.

If no one in the state will provide an abortion for fear of prosecution under the existing law, then the end result is an affective denial of an abortion.

Which I would argue, was the goal of the legislation to begin with.

But it is not established that no one would perform it. The article you posted speculated it was unlikely but did no investigation into whether or not their speculation was true.

The mother was told by the OBGYN at the hospital the day she brought her daughter in, that the closest place she could get an abortion was Chicago.

again, that is not denial of an abortion. it is bad information from the doc - happens everyday. if the doc was truly informed of the entire abortion situation in the state she would (should) have told them that she qualifies for the rape exemption in the state.

I'll add that Florida, Georgia and Indiana all have rape exemptions and are closer to Miss than Chicago so the doc was misinformed at best.

Lol, if there is no one in the state who will perform the abortion, then it's an affective denial of abortion.

Furthermore, the exception requires a formal charge of rape before a provider can perform one, without being charged themselves.

1. It is not established fact that she had to leave Mississippi
2. Whether or not she should have to leave the state is a different question than whether or not she was denied an abortion. The "denial" in this case appears to be grounded in bad intel from the OBGYN.

Depending on where in MS she lived she could have been in IL or FL within a 5-6 hour drive.

But even with that, she did qualify for the rape exemption in MS. It was her mother's ignorance that caused her to carry the child to term and not the law.

and the OBGYN - her lack of knowledge of the law suggests she doesn't know if there are any providers in the state for these instances

it's harder than it should be but it is an option

once again you conflate "probably won't" with absolutely cannot.

you original article says the girl qualified under the state rules AND that the family did not pursue it because they were confused.

FTR - I believe in the exemption and think she should have been able to get an abortion. That opinion is a different issue than factually stating she was denied the option.

She would have 'qualified' for the rape exemption with a formal charge of rape, which she did not have, and which Mississippi hospitals will not commit to honor.

The end result of the law in it's current form, is affective denial of abortions to rape victims.

she wasn't "affectively" (or effectively if you want to use the correct word) denied an abortion. she did not pursue the options available to her and got bad info from the doctor. had she pursued the options and then denied then she would have effectively been denied an abortion.
