Every single paramedic in the country is taught this. There are exceptions that allow EMTs to make judgement calls, like family and friends arriving at the scene. But this is a star QB so I'm gonna blab to my buddy is a blatant violation.

EMT's are covered entities. Journalists are NOT. Also, saying a guy was in an accident is not PHI. Saying he broke a leg in an accident is PHI. However, if the guy disclosing it is NOT a covered entity, then there is NO HIPAA violation.

The "EMT brother" is the one that committed the supposed (hopefully made up) HIPAA violation.

And once again, yes, disclosing for non-medical reasons that someone by name was involved in an accident is absolutely a HIPAA violation if you are an EMT. Ask whatever AI overlord you want

The dude that made that post was not an EMT - which was my point- that was NOT a HIPPA violation.

…and once again, saying somebody was in an accident is not protected health information even for a covered entity. Saying that person (by name) broke his arm in an accident would be a violation for a covered entity, but not for a journalist.

No he isn't. Saying a guy was in a car accident is in no way a disclosure of private health information. SMH.
As a 35 year healthcare worker, I’m well aware of HIPAA do’s and don’ts. I cannot tell anyone ‘hey…I saw so and so in the ER today’. Period. It ends there. No matter if I disclosed or didn’t disclose what they were there for.

If he was on the job (the first responder) and disclosed a name to anyone “not in the need to know”, he violated HIPAA.
