Evidently there was enough evidence to convict Biden but they are letting him go because he is elderly and his mind is shot.

President Biden just took a victory lap in not being criminally charged despite a finding that he "willfully retained" classified material and showed substantial decline in his mental faculties.

The DOJ is defending the lack of criminal charges against Joe Biden while noting the difficulty of going to trial against a "‘well-meaning, elderly man with a poor memory." ...

....Biden is found to have "willfully retained" documents but he is still viewed as too "sympathetic" person for a potential jury. Conversely, Trump was clearly viewed as neither sympathetic nor sufficiently old to warrant such consideration.

...Biden did not even have to show up in pajamas like like Vincent "the Chin" Gigante to get the deference for his age. The Department of Justice released its long-awaited investigation into Joe Biden's mishandling of classified documents Thursday, delivering a damning assessment of the president's 'diminished faculties' and limited memory.

Although the report did not recommend bringing charges against the 81-year-old , it provides a cascade of damaging findings about files found in Biden's garage as well as the president's fitness for office.

In interviews with investigators, Biden became muddled about the dates he was vice president and could not even remember the year in which his son Beau died.

And it said his cavalier attitude to classified documents, such as his habit of reading sensitive files to a ghostwriter, posed a significant national security risk.
