Okay so I have got some clarifications for anyone interested. I spoke to a few NIL lawyers online today and I got some of their insight.

Basically in Alston V NCAA the case that made NIL legal the supreme court found the NCAA in violation of the Sherman anti trust act.

Our legal cases are built off of that same foundation but we are going a step further in saying simply interfering with NIL is enough to violate the Sherman anti trust act.

to that effect Tennessee has given the federal court responsible for the eastern district of Tennessee until feb 6th to issue a TRO. (temporary restraining order) if the eastern district court grants that the NCAA loses its power to touch us or any nil enforcement for 10 days and during that time we will seek an injunction which would make that time period much longer.

In terms of the outcome if we are granted the TRO that means we are very likely to win the injunction and the whole case against the NCAA.

if we are not granted the TRO it isn't over but it means out odds are not very good on this particular case.

A few NIL lawyers I have spoken to think we will likely win the case and a few more have said we stand on shaky untested ground. and even though the NCAA has had some high profile legal losses recently they where able to win a case about amateurism against a few football players that played in a small paid league but then tried to enter NCAA as student athletes. So this could shape out either way. in the supreme court Kavanaugh went a step further against the NCAA in his concurring opinion which will help us but that was only 1 of the justices not all 9 felt that way. so just be aware its far from over or a slam dunk

I personally believe we will win this case but I do not have a legal background. I just want people to be aware that there is not a consensus that we win or lose this.

I will say however this has a much higher chance of working than most anti trust cases because of the way the NCAA is structured and how it already was ruled in violation of the Sherman anti trust act in Alston v NCAA. so if you see a low success rate with anti trust suits just know ours is better than average.
I figure, if they will break up Microsoft over MS Office, they will side against NIL collusion, and would go a step further to side against setting pay to zero in a multi-billion $ industry if asked about that as well.

My son is a senior in high school and been going with me to games since he was 8. Played basketball and baseball in high school and loves sports and the Vols. Was with me as we set with Trey Teague and whipped Bama. Said his best sports moment ever. And that’s after a CG game 1 hitter last year. If NCAA wins and puts us on a crippling probation, he said he will be done. Can’t support a body that is like the NCAA and all college sports will be dead to him. We’ve got to win or else the program will never recover until the NCAA is dead.

I feel the same way. We’ve been trying to get out of this quicksand. It finally looked like we were at least on reasonably level ground and they’re back to put a boot on our head.

I can almost tolerate that the NCAA has its favorites which will never be investigated for anything, but I can’t tolerate the targeted grudge they hold against us. I just want to compete on a level playing field. “The hillbillies are getting uppity again so it’s time to put them in their place.”
 
Wish I had such a horrible job making 7 figures, I know I wouldn’t be crying about it
I’ll gladly trade one of those guys living in big houses, driving nice rides, flying private jets making millions a year to coach a game my concrete company straight up lol
What side of concrete are you on? Finishing or ready mix?
 
How do you know he signed after and it does? Have you read any of the stuff about this situation at all? Spyre said basically what I mentioned. He was signed for his potential as an NFL QB, not as an inducement to come to UT. Easy to infer the signing was before he committed here.
He's been told this already.
 
Mincey is going to get owned in the first quarter or half, then at some point he is going to fake an injury, and our players will be standing over/around him mocking him. Our fans will obviously give him grief every time he does anything. Then the media will say how terrible we are.
I disagree with one portion of your statement.

We will never get the opportunity to stand over him because he won't play at all. He'll have some sort of injury before our game that's lingering..

You guys need to relax. As long as NIL dollars flow and we do it the right way the worst they can do is limit scholarships and post season ban. That is bad, but today you can buy past everything but the post season ban. Kids are going to see who has their back in all of this and many will still want to be on our side.

Contribute to the collective if you can and enjoy the show.
Not sure they can post-season ban due to TN state laws.
 
It seems to me that the universities that make up the NCAA have been at a loss on how to deal with the infractions committee every since the courts granted NIL. The reality is, the infractions committee may be about to rain down billions in losses from court cases. How will they pay? The committee operates at a loss and athletic departments across the country don't have that kind of extra cheese laying around.

I don't find universities to be very good at dealing with the real world.
That'll be easy. Have the liberal arts division do the math. Postmodernism will make the numbers work.

Issue I have, as I understand it. Is that punishing years after the fact, in hindsight is completely illogical. Decrying 'Tennessee is guilty of doing X, Y, Z that's been illegal the whole time,' is silly.

We already passed that bridge. And that's not what its about. Its about a weak ineffective entity trying to make an example out of us. They want to double back across the bridge.

It dont work that way. Could easily answer our call and work it out. They chose pain.

Here is the real fallacy. It only has merit if you cling to their tired trope. They are trying to apply pre NIL philosophy to an NIL world. That philosophy limits player opportunity which has already been upheld as undeniable. You cannot do both genuinely. The NCAA might weasel some way into hitting us with something. But if they do, they just told EVERY other major program they might to them to. They cannot afford a mutiny.

Even if they nip our heels I promise you these eggs are cracked and TN broke them for good.
