There it was. NCAA wants student athletes to commit/sign to a school then do an NIL agreement/contract. That’s not going to fly with anyone including the courts.
This would absolutely curtail an athlete’s ability to earn a fair market value for their NIL opportunities.
 
The NCAA still has institutional supporters and a lot of resources. Even when you think all of the facts are in your favor, you just never know how a trial is going to go. There's no real possibility of settlement for a case like this.

The NCAA can also do what a lot of deep pocket defendants do. They do everything to muck up the process and delay as much as possible.

It's just rare for cases with such powerful parties on both sides to be easy and quick.
As long as the TRO is granted, I’m not sure TN and VA care how long it takes. As Skrmetti says, Congress can also step in and change things.

And yet the NCAA has never investigated how UGA signed Mims, despite it being known two other schools offered him money.

How does it separate the universities from continuing to control things? It sounds like just a new division of the NCAA similar to how they have a D1, D2, D3 NCAA body. This would be like a D1 football NCAA body?


Though I could imagine a few positives, the overarching issues would seem untouched.

Look up NCWA. It's how college wrestling clubs have an organization and still nhave conference and National championships. It's similar to hockey clubs and rugby clubs

That’s a good point. If the state gets a TRO and preliminary injunction, you can sell it as a win and it pretty much lifts the cloud unless and until a court ruled against the plaintiffs.

But even then, it seems to me like the school has avenues of legal attack beyond the antitrust stuff. It’s seems possible that you could just run out the clock on an institution that’s probably on borrowed time, anyway
 
😂 Absolutely horrible invasive things here. No doubt. But in Asia, where they belong, I found out that, while ugly, it's actually a good eating fish. I almost tagged you when I posted that picture until I realized there's no way you would miss it. I almost gave it the caption "I found the copperhead"!

I may have missed it, but has it been announced which judge’s desk the case has come across? All I saw was East TN federal jurisdiction.

I would ask: “Is Kentucky gonna lose their minds about losing a confefence game to a decent opponent like we did last night?”

But I already know the answer is: “Yes, and far worse.”
