Something that goes a bit like this:

1 There is evidence of wrongdoing

2 The evidence is held by a government agency - which will not release the factual material for analysis

3 Courts won't address the issue because those bringing up the issue have no "proof" although normal criminal court cases are all about allegations made by the state, and the court decides if the "proof" substantiates the charges. Meaning the state brings charges with evidentiary findings - not proof - and the court decides if the charges constitute proof of a crime.

Sounds remarkably like another unresolved and basically uninvestigated issue that has interested many of us in the past few years.
