Seems the Jaguars are following the Vol's example

Florida is an “at-will” employment state, meaning employers or employees can terminate employment at any time and without any advance warning. That could make it tougher for Meyer to prove he was wrongly fired or should be owed the remainder of his contract.

AP source: Jags fired Meyer for cause, don't intend to pay

The "at-will" concept comes into play when there is no written contract. Otherwise, the contract provisions regarding payment due following termination apply. In this case, the legal issue is whether the facts support the exercise of the termination for cause provisions in Meyer's contract, the same as it is for Pruitt's contract.

Thanks.

Was passing along what I read earlier.

Personally think both the Jags and especially the Vols have standing to at least negotiate a settlement versus a full buyout.

Pruitt caused irreparable loss with the yet to be determined penalties from the NCAA.

Meyer is a little more dicey IMO. Playing grab@ss with a young woman and putting an awful team on the field is shakey.

They said the alleged Lambo incident had nothing to do with the decision but there could well be undisclosed incidents as well.

Those who have been paying attention know. The University isn't negotiating anything. Not paying anything. No buyout. Pruitt and his lawyer tried to strongarm some kind of settlement with a thinly veiled threat. UT told them to pound sand. And they quietly went away.

Not sure what you intend with "standing"; that's a legal term that doesn't seem to fit there. Perhaps you meant that they have at least some facts to support arguing their position?

As to what incidents will support termination for cause, it's impossible to say without reading the contract terms, and even then it may be difficult.

Arkansas actually set the precedent not paying Big Brett I believe.
I'm sure it happened before Mike Leach at Texas Tech, but his was the most successful example and that was 10 years ago.

Pretty much what I meant to say. The school and the Jags would have more standing in counter suits than either coach would if/when they file suits.

I am not a legal scholar nor am I well versed in jurisprudence like many here om Vol Nation however.

Heh, thanks. Sometimes, when it becomes obvious a guy is trolling, you just gotta troll him back. :)

Took you long enough to figure it out that you were being trolled. :D:D

I am well aware the University broke off any settlement negotiations with Pruitt and his mouthpiece at the end of October.

That doesn't mean they won't eventually file a suit however.

I would think the Lambo incident can easily be interpreted as an assault in this hyper-sensitive world we live in now. I believe Mr. Shad Kahn has wanted to fire Meyer for quite some time; however, nothing rose to the level of a possible criminal act. Now look, I'm not personally advocating that Urban be brought up on charges. What I am saying is we all know there are those very vocal folks today that will say that under the right (self-serving) circumstances. Who knows how the news cycle would have framed this if it were two individuals of different skin color. I am not saying that is right, I am just acknowledging that I honestly feel that kicking the kicker was Kahn's way to dump Urban and walk form his contract.

Well it was well done. That was a grand slam, hat trick, and a sack for a safety all rolled into one!

I may use that again. Against some of the fans of rival Aussie Rules teams. Either Hawthorne or Collingwood. Can't wait to see the meltdown. Thanks so much.

Yeah, that's not "standing".

Just working off what the Jags are currently saying about Lambo

The only reason the final announcement of the decision was delayed was because of other planned events, the spokesperson told the AP, and had nothing to do with former Jacksonville kicker Josh Lambo's accusation in the Tampa Bay Times that Meyer kicked him during an August practice. Lambo's story came out hours before the Jaguars announced Meyer's firing.

Sources: Jags don't plan to pay Meyer's contract

I think the Lambo incident could still be a factor when push comes to shove however partially for reasons you mentioned.

If nothing else, they dropped the story just before firing him to help with the court of public opinion.

Tennessee can also file a counter suit. Pruitt doesn't have the money to be locked up in litigation for years. Tennessee does.

Brother, you have just been hit by the Baader–Meinhof phenomenon.

Look it up. It is interesting. And is 100% what just happened to you.

[hint: Tennessee wasn't setting any new precedent, and the Jaguars' decision likely had absolutely nothing to do with a "Tennessee example"]
Happens to me every time I buy a new car..
