Not really. If he does declare martial law or invokes the insurrection act orders to deploy would be lawful. If he doesn't there will be no such orders. It's that simple.

I am against him declaring it for a myriad of reasons , but eventually if the governors don’t stop the riots there will be enough citizens asking for him to do it that I think he will. It’s just like the stay at home orders , people will take anything for a short time then they will get tired of it .
