Latest Coronavirus - Yikes

I agree in principle. Problem is that if somebody picks up the virus at a gathering and then leaves, those they may come in indirect contact with afterwards aren’t given a choice.

When a person chooses to enter the public during a known pandemic, they are assuming the risk of contracting the virus. But they did have the option of mitigating the risk by isolating themselves in their house.
 
You can't yell "fire" in a crowded building because people may get hurt in the stampede. Likewise you may not be allowed to assemble large crowds when a known highly communicable pathogen is spreading through the population. May be something SCOTUS eventually looks at.

I'd be interested in seeing SCOTUS rule on this.

or you could pre-treat your Corona with a Gin and Tonic

That's what I usually do... I'm fond of a little grapefruit juice too.

I will be doing some pre-treating for sure.

Edit: I looked him up online. His office is basically in a strip mall.

In the fight against Covid-19 though we might look forward in doom, one day we will look backward in awe. In an article last week, I discussed a promising drug combination to treat the disease. There is now new data supporting this treatment. Since then, Kansas City area physicians, including Joe Brewer, Dan Hinthorn and me, continue to treat many patients, and some have shown improvement. Major medical centers including the University of Washington and Mass General have added hydroxychloroquine to treatment options.

So, Liquor store was curbside only... after about 30 mins discussing what they did and didn't have while standing in front of the door, I ended up with a half gallon of Gilbey's Gin. whatever... it''ll do.


I’m part owner of a craft beer store. Kinda like Casual Pint. After NY was basically closed down, within a week we converted to completely online ordering, pick up and delivery only. Business is still down compared to normal, but it’s keeping us above water and employees working.

Point is....it won’t be long til you get what your looking for.

I was referring to that one specific GP who has supposedly successfully treated 700 patients.

I'm not a legal expert or Constitutional expert but I believe if you falsely scream fire in a crowded building and someone is hurt or killed in the scramble you won't get very far in court claiming it is your 1A rights to have done so.

It would simply fall under disorderly conduct type law.

So our largest case day is still lower than their lowest day per capita.
20% of the entire US cases are in NYC

Judges order Texas and Ohio to Allow Abortions during coronavirus Pandemic

Federal judges have ordered Texas and Ohio to allow abortions to continue during the coronavirus pandemic after lawsuits from Planned Parenthood.

U.S. District Judge Lee Yeakel on Monday blocked Texas from enforcing a recent order, which labeled abortions as nonessential medical procedures that must be suspended in the state amid the outbreak.

"Regarding a woman's right to a pre-fetal-viability abortion, the Supreme Court has spoken clearly. There can be no outright ban on such a procedure," the judge wrote.

In Ohio, Senior U.S. District Judge Michael Barrett temporarily blocked the state on Monday from using its public health order to halt abortions.

Planned Parenthood filed similar lawsuits against other states over coronavirus abortion restrictions, including Iowa and Alabama.

There was never a court case that held that you couldn’t yell fire in a crowded theater so it couldn’t be overturned.

It was an axiomatic statement: essentially, that nobody would argue that the first amendment would protect that speech.
The rule announced in Schenck was narrowed in 1969 but it was more of a re-articulation that was still pretty close to the same test, it just required a bit more immediacy to the lawless conduct.

In 2010 the court opened it back up and (shocker) gave broad authority to the government to punish speech that poses a public danger or danger to the government.

Under any of the three formulations, shouting fire would absolutely have been punishable. At least in the context of the 1919 theater. Yelling “Gun” in a schoolhouse might be more applicable today.

I’m guessing these particular tests likely don’t offer safe harbor for this preacher, either. But mostly because I don’t think the test (and therefore the axiom) is really the one that is applicable except to rebut the idea of a boundless 1st Amendment.

I’d expect this case to get dismissed after this blows over, unless he keeps having services, which I bet he will.
