I'm speaking to culpability as opposed to responsibility. Is the head ball coach legally culpable for a subordinate not following the rules, or procedures that the coach has set forth?
Like I told CWV, I couldn't care less how Butch looks, or that we call him a poor leader. That seems to be very plain. I'm asking if Butch will be held culpable for his assistant's decision? Will the legality of this he-said, she-said legally enable UT to fire for cause and escape the buy-out?

I understand your position now and completely agree with you as to the uncertainty of the legality aspect of releasing him for cause.
My position was that ultimately the culture influenced and policies set forth are the HC's responsibility. Any breach in policy or deviation from the SOP would require action. Especially in this case, where there is a protocol in place, a culture of safety first, and his responsibility to ensure dissemination of information and education of staff on the concussion protocol. That places the ultimate responsibility on him. Alot of different scenarios here, such as, his staff were not properly trained, there was an atmosphere of win at all cost, an atmosphere on some level of fear to tell the HC about this and not continuing to try to keep play him, or his staff took it upon themselves to deviate from protocol or SOP.
I am not versed in the legalities of the evidence needed for releasing for cause so my opinion is there is alot of grey here. So, yeah, I definitely agree with you on the ability to release him for cause. And also agree that it would look very underhanded on the Universities part in the court of public opinion. Lord knows the UT brand has been tarnished enough as is.
I have been like someone else on here said just a nobody with NO connections at all. I have been "trying" to keep up with this thread because I feel like it is one of a VERY few that have people that truly do have some connection or information. I have one question that maybe some of you can answer for me... WHY in the world would CPF and PM anyone else as connected and an integral part of Tennessee football stand back with all of this trashing of this University in the public eye and NOT come out and say ENOUGH is ENOUGH!! Do something and DO IT NOW!!??
Understand I have never posted anything here before other than looking for tickets to games but am an AVID VOLS and LADY VOLS fan in the land of puppies and dogs... Just looking for something to hold on to I guess.

I've enjoyed/been aggravated, frustrated by this thread for weeks but I think the writing is on the wall concerning my understanding of the situation.
Hawk, you pimp the journey. Well, so far, this journey has sucked. Have there been some highs? Sure. But overall, it has all been just one big gut punch.
But the parting of ways stops the butch part of the investigation.
I can only guess/hope when I answer that.
A couple scenarios.
- We offered Gruden and he accepted. In this scenario what is the benefit of firing CBJ? Especially if there is truth of the infighting between assistants. If you fire CBJ ALL of the attention is focused on the hire at that point. Maybe there were discussions with Gruden and he said that would make it difficult on him with ESPN and such.
- We offered Gruden and he rejected. Again all attention is focused on search.
-Currie has no clue what he's doing and we are screwed
Those are the main ones I can see. However I see no advantage in a bunch of attention on a coaching search at this point. Especially with the way the last few have went down. Furthermore the UF situation I think plays into this a little. If Butch is fired it easily exposes our hand and we are in a confirmed coaching hire war with UF. Then info leaks on who we are talking to. I kind of like the idea of UF in the dark as to what we are doing.
Just my opinion and just so you know I am a nobody.
I think now, though, that the fast break becomes the clean break. A quick parting of ways without admission of guilt or laying of blame would help both parties.
Im mad at the whole crap show thats going on at my beloved university. I agree that boycotting the game would send a message. But my daughter has a soccer tournament in Knoxville this weekend and my kids (oldest 2 are 12 & 11) are dying to go to a game. Ive refused all year because of how bad they are. But after thinking about it, game day is special. I grew up in the 90s going to every game as a kid and it was magical. If I dont share that experience with them, we could lose a generation of fans who dont appreciate Football time in Tennessee. All that being said, my family is going to the game to support the players on Saturday as well as the ones like OldVol75 who sacrificed their bodies to make it what it is. Anyway, hope this is solved soon.
From a liability point of view, I see no way now that they have a public break with Butch until the University is satisfied that they know all there is to know about what happened with Kendrick. While Butch is still publicly employed, he has continuing obligations to cooperate with the investigation.
Incidentally, not cooperating with the investigation could constitute "for cause" for purposes of termination under several provisions of section 3.2.2.
