Usually is the case. Would take something off the wall (like Josh being given a portion of assets or stakes in a company or something along those lines for him to possess that amount of assets or him being listed under the family's umbrella policy.

Otherwise, since Josh is an adult, family's assets SHOULD NOT come in to play. And the lawyer should know that unless the roommate is privy to some knowledge of Josh's assets
 
I'd tell him to have fun filing. Even though the homeowners policy wouldn't pay, they would defend you. Would be hard to not assess comparative negligence to roommate in a fight as well limiting any recovery. If roommate started the fight and any witnesses to that fact then a defense attorney could easily place 50% comparative fault on plaintiff and bar him from any recovery. Putting it in the news and Jimmy Hyams slobbering all over himself tweeting it 4 times is an attempt to pressure the family. I'd tell them to have fun and at the same time be expecting the counter complaint from me as well.

I was beaten so bad that I had to be revived..7 different broken bones...did not have anywhere near a 6 figure hospital bill.

Besides that..he is not asking for medical costs. He is asking for almost a million dollars.

If he has medical insurance that's all a game. 100,000 in bills become 10,000 after service rate agreements. That's why there is a Tennessee Supreme Court ruling on which figure is an accurate representation of bills/injuries since hospitals take the agreed price from providers. I believe answer expected around September

Smith is over 21, right? WTF does his father have to do with it? Kid can't sue Smiths dad. Let the kid file his suit, see how far it goes in court. Even if JS loses, he don't have $3 mil, can easily declare bankruptcy and screw the kid out of any settlement he won. Plus attorneys fees would be $100k easily so the kid is stupid.

Please don't sell me about Josh Smiths future earnings in the NFL. Not sure he'll even get a FA invite. Typical Dooley recruit.

It's been stated numerous times in this thread and newspaper accounts that Josh "finished it" by kicking the roommates face in when said roommate was lying on the ground.

You're cool with that and apparently a lot of people on the board are, too. But the law see's it differently.

If that's what went down, I am definitely NOT on board....

This was never going anywhere. Just an attempted shakedown by a kid and an attorney who thought there was some quick cash to be made.
 
You lost a fight against a close friend and your answer is to sue? This really highlights a couple of major problems with our society. Primarily a sense of entitlement with our youth.

Life isn't fair, life isn't politically correct. Time to grow up. Nobody owes you anything. You got your ass kicked, it's happens to everyone.
