The Manning incident was 20 years ago. If the plaintiff wanted Manning punished further she could've chose to go forward with prosecution back then. As it is the case was settled and should not be allowed to be included in lawsuits decades after the incident. Lawyers please correct me but if you settle a case out of court then that means it is resolved and further action cannot be taken. How is this even permissible?

Congrats to the plaintiffs' attorneys for seeking the lowest common denominator to do their bidding - the sleazier media hounds. They have dug deep into UT's sewage to build a case. Rationalize all you want, but this is a money grab. So it is up to UT to counter using their media hounds and legal resources. Which is why to settle now is not wise and would be an admission of guilt to the more serious charges having long term repercussions. They may choose to settle down the road, but now is the time for an offensive. The university will soon learn who their real friends are. KNS will not be one of them.

Butch runs a no-nonsense, clean program and recruits higher character guys. That should reduce the number of incidents. There should be no holdouts left to support the atrocity named Dooley. But in truth, his crap was a continuation of failure from the later years of Fulmer into Kiffin's. Hart's baggage that will hurt an earlier resolution is the optics of the LV issue. He will also be smeared with the more recent sexual assault complaints that occurred under his watch. Cheek will also take it on the chin, although I doubt anybody cares. If there is a settlement at some point, those two have to go as part of the fall-out.

The only response to it all is to tackle it head on with a sledgehammer. Once the other side gets beat up for awhile including their media sleaze bags and there is resolution of the pending criminal cases they can reassess the options. You now have all the evidence you need about why you hire head coaches that run clean, disciplined sports programs with AD's that understand women's athletics and their related nuances. The alleged sexual assaults come from character issues by one or more parties to the alleged assault. That is for the legal system to sort out and why Title IX should be blown up if the onus is placed back on the schools to do the legal system's job.

We will survive this and the university will be better for it in the long run. Always shine the light and make corrections. PM's legacy get drug through the mud a bit. He can handle that on his own. The Vol fan base moved past all that two decades ago and it will have zero impact on recruiting as we have seen at FSU.

Statute of limitations applies. Peyton probably will refuse to comment and go about his life. As he should. All questions have been asked and answered.

The plaintiffs are clearly looking for headlines. They want to try this case in the media and create enough public outrage to prompt a quick settlement. Anybody that they can drag through the mud, they will. Lawsuits like this benefit no one but the plaintiffs and their attorneys, because they treat real issues frivolously to make a buck.
 
Anyone who is the least bit objective has got to admit that Butch has been over the top vigilant on this issue versus his peers. This cloud will pass, IMO.

Sorry to interrupt the discussion, but may I ask a favor from my Volnation friends.

Yesterday, my grandfather had a heart attack and he had to be taken to Park West hospital. He stayed in the ER cardiac unit for a few hrs then they transferred him to a regular room later on last night. He is stable right now and slept well last and his blood pressure remained good throughout the night. Just wanted to ask if you all will say a prayer for him and that he will continue to improve. He raised me and is like a father to me.

Mark Howard on 104.5, who has no affiliation with UT, and not someone I'd call a Vol fan, was absolutely RIPPING Sean King and called him a "scumbag with an agenda". Says that this is rehash of what's already been known, he's not defending Mannings actions, but does state that the details are from the plaintiffs side of the argument and should not be construed as pure fact. Howard called the whole thing a hack job.

Heard this as well. You are correct, for Howard to say this means something.

Well, there hasn't been a cover up since Butch has taken over. If there has been, then it might be the best cover up ever seen, because no one has heard a thing about it. All incidents that have occurred under Butch from rape allegations to domestic violence to impermissible benefits to arrests to alcohol consumption under age to whatever else has happened has resulted in immediate suspension by the university. According to Butch, that is an university policy. If so, then how can the current administration and football staff be held accountable for anything. If things occurred and were covered up under prior regimes, then there is a case, but it shouldn't shine negatively on the current regime and university. This is all in relation to the Title IX lawsuit that was settled at FSU. All potential past victims are seeing an opportunity for a money grab. Peyton's victim has already done it twice.

Also, I'm not saying in the least bit that any true cases that were covered up shouldn't be dealt with...if any rapes or heinous crimes were committed and covered up, dig and bring them back up, and go to trial to prosecute the perpetrators! They deserve every single punishment that they have coming...no matter who it is.
Good points. The way I read some of the articles though it made it sound like UT was covering up rapes under butch. Maybe it was a Barrett sallee article that gave me that impression. Either way you and I both seem to agree that if things have been covered up that those responsible need to be penalized harshly.
 
It would be pretty shocking if King uncovered dirt that even Anita/the Tennessean failed to unearth during their multi-year non-stop investigation of sexual assault at UT.

IIRC - immediate suspension from the football team. I don't think the players were suspended from the university.

Edit: You said "by" the university - maybe I misunderstood what you were saying?
 
Wasn't it reported he was suspended in the spring but the reason(academic) was inaccurate ?

Ah, I thought he wasn't actually suspended.

Maybe he was suspended for both academics and the accusation, but they only publicly reported that it was for academics to keep him from being dragged through the mud.

Yeah, although a true cover-up to me would be going as far as hushing the accuser, the police, and the media. Sounds like Butch/the AD simply didn't volunteer (no pun intended) information to the media that would immediately be front-page news in the sports world.

That's probably enough to be considered a "cover-up" in the eyes of reporters, especially in light of the sexual assault lawsuit, though.

From what we do know it all sounds a little fishy to me that it wasn't uncovered at the time. Perhaps it was all on the up and up but this lawsuit will determine that I am sure
