Von Pearson WILL NOT be charged

Maybe this has been answered but I'll ask anyway.. Is he coming back to play or is that still unclear??
Just read Times Free Press article saying "they (team) is aware but his status remains unchanged"! ?!?!
 
There needs to be a lot of evidence for rape charges to go through, just because he isn't charged doesn't mean the team has to reinstate him. The school should allow him to re-enroll, but the football team does not have to (not saying they shouldn't). None of us really know what happened though, sucks for him if he didn't do anything wrong, sucks if he did and goes unpunished.
 
Well, I wonder if that wasn't the easy part/phase, having no charges brought by the DA's office. Now, the hard part....getting a bunch of politically correct liberal UT officials to lift the university's suspension and allow him back on campus/in classes. We'll see.


Who are these people? What are their names and positions with UT?
 
well, 1st, they didn't say "no evidence", just "insufficient evidence". which, and this is just me, just doesn't instill a ton of confidence that absolutely, nothing happened. i don't know what did or didn't happen. it's just the choice of wording by the DA, and generally, i think they try to choose their words carefully. i would feel alot better about all of this had they said "we found no evidence supporting the claims, and will not be pursuing any criminal prosecution" or something along those lines.

as to the original ?, what's my angle...it's simply that with the current state of affairs on college campuses, specifically in relation to football players and violence against women, the well documented issues in the NFL with the same issue......that i think UT has to tread lightly when deciding what to do next.

in all honesty, i won't have a problem if he's reinstated. but i would expect some, maybe severe, criticism given the current state of affairs.

but i won't have an issue if he's not either, i would completely understand why.

Thank god this is only your opinion. Your post with the exception of agreeing on item two is complete and total PC BS. I know this is from 3 pages back but damn, no DA in his right mind would ever completely exonerate anyone on the .0005% chance that they could be wrong. That is straight up common sense of which you appear to have none.

UT should use this as an example of "we took strong and immediate action and let the authorities work it out. There are no charges so we are lifting or suspension."

Just sucks to be a young black man doesn't it or to just be alive. Guess you are good with what Duke did to their Lacrosse team.

Typical. Still holding the suspicion of guilt over his head after he's been cleared. Unbelievable.

Not at all on my part...just saying that Butch is going to cover HIS own assets and have a nice long talk with VP before placing him back on the team...it is the scenario that would play out on ANY football team in America...from Pop Warner on up to the NFL.

BTW - Hoptown, I see you are a Bruins (Hockey is the number ONE most under-rated sport around) and Pats fan. Not trying to fling mud or anything...just want your honest opinion because I respect it...what is your take on Brady's situation...does he serve all 4 games?

Sorry to be the bearer of bad news, but it doesn't look like he's going to be reinstated any time soon. Yesterday, Pearson's attorney Chris Coffey told the Knoxville News Sentinel that "Pearson eventually will have an administrative hearing with the university to determine whether he has committed a student conduct violation, but that has not yet been scheduled." Today, the News Sentinel elaborated on how long that process could take:

Margie Nichols, the university’s vice chancellor for communications, said Wednesday that federal privacy law prohibits the university from even confirming that there is a student conduct investigation into Pearson let alone whether or not it would maintain its interim suspension in spite of the lack of criminal charges.

Pearson’s status with the university will obviously affect his status with the football program. Ryan Robinson, athletic department spokesman, said Wednesday the UT football program is aware of the district attorney general’s decision, but said Pearson’s status with the program has not changed.

Though Nichols could not comment on Pearson’s case specifically, she pointed out that the university’s investigations into potential student conduct violations are not always directly connected to the criminal investigations into the same matters. The fact that the district attorney general has dropped its case does not require the university to do the same.

The university is also burdened a lower standard of evidence in student conduct cases than the state is in criminal cases. While criminal prosecutors must prove a defendant guilty beyond a reasonable doubt to gain a conviction, university attorneys must only prove that there is a preponderance of evidence that the respondent in a case committed a conduct violation for that respondent to be subject to university discipline, which could include anything up to expulsion from the university.

“If we have a case, it’s totally separate,” Nichols said. “The burden of proof is different. Even if (criminal prosecutors) don’t have enough, we can still proceed.”
 
Von should just tell Butch & UT to gth & take his talent to the pros asap. They have treated him like crap, imho

Holding a young man's life in limbo for this long is what is criminal. Wouldn't blame him for wanting to get the hell out of Knoxville. The whole damned UT administration system should have to answer for this travesty. This is how the UT football "family" is treated...guilty until proven until...o.k., that's enough? :thud:

Good lord. UT has a greater responsibility to protect their students than to make sure they are able to play football. The "victim" was a student at UT so likely the safer bet was to suspend him from campus until it could be sorted out especially with the spotlight that's on the university right now. It looks like he probably didn't do anything warranting prosecution but I understand the safety of students comes before possibly delaying a player's football career.
 
If understand earlier comments correctly, the UT investigation was occurring concurrent with the legal investigation. Jones said something to that effect.

Unless they found something, it should not take long.

It has already been stated and re-stated that this will be cleared up one way or another in the very near future. You just posted an article that basically says nothing

So you are saying that over the last 4 months Butch hasn't already HAD that conversation over and over with VP? Yea I doubt that. Butch is ready to return him to the team IMO but he has to wait for UT clearance.

What did you expect? Reinstated to school and the team before the charges were cleared? When his name went public, Tennessee would have been dragged through the mud for NOT suspending him. Don't blame the university for doing what they had to, and it took way too long, just because the cops and DA took their slow sweet time getting this put to bed.

Ok. To those that are trying to make more of the term "insufficient evidence" being used, you are still trying to determine some level of innocence or guilt. This young man was never charged with any crime. His life has been put on hold for months and his future is in doubt due to accusations that were made by an angry female. I don't know what really happened, and don't have to. Did he do "something" to offend this young lady? Maybe, but if he had raped her, and as quickly as this was acted upon, there would not have been "insufficient evidence" to the crime. If you look at the AJ case, there were immediate reports of some type of evidence. I'm not saying AJ is guilty, but they found enough to charge him. In Von's case, there has never been reports of any real evidence. If this were your son or someone close to you, would you be so judgmental due to the term "insufficient evidence". I say reinstate the young man ASAP and give him his life back. Go Vols!!!

Thanks. No, I've followed this whole sad situation, and its haplessly insane. I remember studying the Ideal Gas Law in physics class, and our
professor used a football for the demonstration. I dont remember the poor guy's name who volunteered to go stand out in the cold for
1/2 hour but it was an interesting lesson learned. And the fact that neither the NFL or Wilson knows what happens to a football when you take it
from the locker room onto a playing surface under 40 degrees is an indictment of the league and the people that make the damn balls. Not Tom Brady.

How 3/4 Colts balls were ruled under the official psi and THAT is not an issue, but the Pats readings, which weren't recorded, and taken by uncalibrated
gauges .4 PSI apart, should be all the proof anybody needs that this is totally overblown, a nonissue, and that Goodell should be deported.

They consider him a "threat to the environment" or some other stupid PC nonsense like that. Thats
what I read the other day, why he's suspended.
 
To have him reinstated, and for damages if they dont! Duh!

The fact that UT has stated they are holding Von to a higher standard than KPD and the DA's office
is a travesty. Ever heard the saying "Nobody is above the law?" Well apparently UT thinks they are.


Do you have any clue about what you are blabbering on and on about? If UT decides that he has violated their code on conduct, they can boot him and there isnt a thing he can do about it. Exactly on what grounds would he be able to sue?
