Christian activist judge orders Alabama officials to disobey the law

Where in the Constitution does it say the federal judiciary has supremacy over the state legislature in this matter?


The Fourteenth Amendment.

Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

The very purpose of the 14th amendment was to take federal rights and announce that no state could abridge them. The point was to ensure that state and local governments obeyed federal rights.

Rather an important provision of law.

Watching these knuckle dragging, mouth breathing, uneducated, backwoods bible thumpers squirm and cry about something that's never going to go their way from now on brings me great joy. There's something sickly satisfying about seeing the death throes of a movement so clearly on the wrong side of history.

No, not at all - he didn't ask about the judiciary writing laws. He asked where in the constitution the federal judiciary was supreme over state legislation.

It's literately in the Supremacy Clause of the constitution.

The Supremacy Clause is the provision in Article Six, Clause 2 of the United States Constitution that establishes the United States Constitution, federal statutes, and treaties as "the supreme law of the land."

All true but in this case we have differing federal court rulings. That's why I asked several pages back why doesn't everyone just cool their jets until SCOTUS rules in June. Then one way or the other it will be settled for good.

Half my family lives in Alabama and the anti gay marriage crowd is very loud and hard to miss. I have met plenty but your stalking is flattering

The 14th amendment was written to protect former slaves. That was its intent. It was not meant as a Pandora's Box.
