AJ Johnson Accused of Sexual Assault

Partying until 3 am is the reality of college aged kids, I did a few jaagerbombs with peyton at 3 am back in my school days, sometimes on the nights BEFORE the game. We went 'HAM' and that's just the life of college kids.

It's so not 1996 anymore though. You can't do anything like that in public and expect it not to be all over by morning.
 
I'm not a cop.

But if there is evidence of wrong doing, and enough to label them suspects then why do the cops need to turn it over to the DA?

Cops have the power to arrest. No need to wait around on a DA.

Maybe I watch too many cop shows.

A poster here who is a cop posted in the previous thread, that rarely will cops make arrests before turning over to the DA unless the person(s) are caught in the act.
 
Peyton Manning? The night before a game? Sorry, can't buy that. The team is sequestered the night before games. Peyton doesn't seem to be the kind of guy who would sneak out of the hotel to pound drinks at 3 a.m. the night before a game...

From what I have heard from Law Enforcement. Is that basically they take statements from Accuser, gather as much info and evidence as possible. File the report, turn it over to DA. The DA then executes warrants if there is enough evidence.
Apparently these things are not as cut and dry as you would think. The only way you would possibly get arrests on site is if they actually caught perpetrator in the act. Now Tennessee Law may differ, and I know the wording isn't exact.

It also depends on the exact charge.

In domestic violence cases, if a spouse accuses the other, evidence or not, the accused spends 12 hours in jail, typically.

It's called a "cool down" period. If it's been a few days between the allegations and the arrest, one might get out earlier but typically it's 12 hours.

A lot of spouses will use this as a tool in divorce to gain control over the house and finances while the other is dealing with getting out of jail.
 
The fact that the girl received medical attention really doesn't make me feel like this is about to blow over.

That plus "forcible" and the fact that the report says the alleged victims reported/called the incident right after it happened (verse in the morning). Not looking good for anyone involved.

It doesnt mean anything by itself. If you report a rape they will strongly advise a rape kit which is medical treatment. If she said no itd most likely drop right then and there.

Are all the folks involved in this still on campus? Attending classes?

To me rape is in the same ball park as attempted murder. Both are violent and emotionally damaging.

I agree. I'm just waiting on the other shoe to drop at this point.
 
The medical attention she recieved was most likely a rape kit. If she had any physical Injuries they could have arrested them then.

That's what I assumed. I guess I was wrong. Bodily harm would be present, and a arrest made.

Nice friend. You see your friend forcibly raped and distance yourself from her asap and drop a charge within hours of the call? Odd to me.

I agree, while both are serious. Rape is a whole new level.

She still has tests, projects, homework, possibly work, etc.

So the friend witnessed it happen, then doesn't file charges, and leaves town??

Im curious if there was any physical evidence. That certainly does not mean a rape did not occur but a 45 minute rape is hard to imagine zero bruising or tears. Also, AJ being a part of a 45 minute episode with the character shown to us by him is hard to swallow if true.

I disagree. As sick as this may sound, if there was rape/inappropriate sexual conduct, I was hoping for the too drunk/blackout type. At least there is a vague element of plausible deniability; being that she consented, although both drunk, but the victim and/or perpetrator not remembering whether or how consent was given the next morning.

When I hear "forced rape", I envision a conscious victim being forcibly held down and raped. I'm not sure that is what they are referring to. Hopefully one of our resident lawyers or law students can shed some light.

I believe "forcible" would mean any instance where consent is not given.
 
Men in general esp teen boys are accused every week of it. Usually it's crap some times it's not. Just hold off til da does or doesn't charge that will tell the tale
