If the point is that there is no distinction, then please answer my question.

What happens if I burst into someone's house at 3AM with a black mask and a carbine? Then I shoot him because he's pointing a gun at me, after I shoot his dog?

Depends on the kind of dog. I mean are we talking a chihuahua here? Because that is like a public service in my opinion.
