I would assume that speaking publicly before a settlement is going on the offensive.

My guess is the university is standing up to this issue. We can't police what players do outside of football or any other sport; however, we can make a statement that sexual assault and related acts are taken serious. We do not condone these acts but sometimes they happen like they do all across America and we have acted appropriately in every instance since this administration.

Let's see what is said before before reaching cynical conclusions. If it is made clear that the allegations contained in the lawsuit are believed to be without merit and that there are no plans to settle, I would consider that fighting back.
