Title IX does not apply to name, image and likeness deals, the U.S. Department of Education said Wednesday, rescinding the Biden administration's guidance that schools must equitably distribute direct payments to male and female athletes.

'When a school provides athletic financial assistance in forms other than scholarships or grants, including compensation for the use of a student-athlete’s NIL, such assistance also must be made proportionately available to male and female athletes,” the memo states.'

Not just NIL, it is financial assistence other than scholarships and grants. It includes NIL but is more than that.

Key phrase "...when the school provides..."

This doesn't affect private NIL in the least.
The NCAA is still intentionally - and dishonestly - conflating revenue sharing and NIL to sow confusion. It's a backdoor way to try to get around their antitrust issues. It's not working for them. There are already at least 10 challenges to the House case settlement. All are based on the NIL clause.
