Need some legal advice

Background: I have been working for a major oil company for almost 20 years. I have never received a bad evaluation in the time frame. The other day, I received the lowest evaluation possible for last year. I worked 60 hours a week last year, and never declined a challenge. I was told that this was becuase the nationals complained about me. Basically, my rating was lowered due to what the communist think. They never gave me a chance here. Three months after my arrival, the local management(Vietnamese) came to my office and screamed he was not satisfied with my performance. He then went on to tell this to all his local management and my parent company also. I could professionally never recover from this .Nobody told me this until my evaluation.

Anyway, I have decided not to sign the evaluation. It can go all the way to the CEO for all I care. I blame my parent company manager more than the nationals. He is the politician. My father always told me you could judge a man's character by how he acts when he is away from his wife. This guy is a real snake.

My question is...Does anybody have any advice or somebody I could talk to about my legal rights here. I am not in this for the money. I don't care or need it. I am doing it so I can look my son in the face. This is one of the most unfair things that I have encountered in the oil business, and that is saying allot. I would appreciate any help on this. I would be willing to give a lawyer 50% of the take.

This has really set me back, becuase I care about what I do as a professional. Every year my company and my professional organization makes me sign an ethics agreement. I cannot sign this evaluation and not violate those agreements, despite the potential of losing a very high paying job....even in today's economic environment.

PS. I tried t put this in the PUB, but could not. However, my supervisor is quite the politician, so maybe it belongs here afterall,,,,,,,

Sorry to hear of this Overseaorange.

I applaud your stand on conviction. All I could offer besides moral support is something you've probably already done - understand the grievance procedure in your organization and follow the process exactly with documentation.

Plus, I wouldn't make that 50% offer to a lawyer! : )

Go to HR and tell them you dont approve of your PR and want to have a 3rd person involved.

I am sorry to hear of your struggles. I have a friend who went through a similar situation in the aircraft industry. He got an attorney involved.

I agree with volinbham, I would not utter that 50% thing out loud.

I hope it all turns out well. I'm going to go ahead and put this in the pub for you.

I'd recommend you tell the guy you are real friendly with John Kerry and Bill Clinton, that should get you a top rating.

I wish I had better advice, but all I can add is fight it. Don't give in. As you implied, it is a matter of honor and justice. Whether you are successful or not, it would be wrong not to fight this. Good luck, and I mean that very sincerely.

Thank you all for your advice. I am ready for the fight. However, I might have to change my name to, "Not overseasanymore",which after 11 years, I am ready to come home and see more VOL football.

You need to find out Specifics.What are the allegations made by the locals and what are your companies internal protocols for handling this type of situation.You should not feel the need to rush a decision based on your current dilemma.find out your companies disposition and procedures.If all else fails ask for reassignment.

I may not have the best advice for you, but before you continue to fight this.. Make sure your understand what your signature means on the evaluation.

It may not mean that you agree with it, simply that your manager reviewed it with you.

The sad thing is that you should never go into an evaluation, with a big difference in what your expecting and what you recieve.

We have a very through process in our company, with frequent reviews throughout the year to review not only performance against goals, but also progress against personal development and improvement.

Even if your company doesn't have a formalized process, throughout the year, you could schedule 1 on 1's with your manger quarterly or at a minimum semi-annually to review your performance.

Ding, ding, ding. We have a winner. I will be asking for a transfer. We are suppose to have a mid-year review, but my manager always shy's away form his supevisor role. He has admitted to me that he never wanted to be a supervisor, and his lack of effort at it bears it out.My opinion, then don't be one. He never gives me any notice on anything. He has been in my office one time in the last year at my request. So, I do think a transfer is in order. He does not like me, and I cannot respect him.
