Apparently he's been released because Miami police say they didn't mean to issue a warrant.

This should be fun for any of you prone to conspiracy theories :)

I'm still thinking that if anyone had an outstanding warrant, there's no way they'd be a high profile (somewhat) football player at a large university.

Generally people with outstanding warrants go into hiding.

I'm also wondering why the KPD officer felt the need to do the big check on him...quota?

That was my first though yesterday. How could a warrant be issued and be outstanding for a d-1 college football player? Wouldn't his name stand out to someone? Wouldn't they see him missing tackles on tv?

Depends, but probably not. Defending Florida police agencies is what I do, so take that with whatever grain of salt you feel appropriate.

I would imagine it's routine on a traffic stop. They're already running your license

Only because you guys made him sign a release before releasing him. It is called false arrest my friend. I would love to argue the little release he signed was under duress. Who wants to get Morley some legal representation and get to the bottom of this because something smells.

Based solely on what I read here, there would be a sginficant legal hurdle for any lawsuit versus Miami police and I can elaborate more if you'd like. Bottom lne is that paperwork snafus like this are tough to sue upon because there isn't an actionable legal duty to get it right. There are some exceptions, but none apparently applicable.

The length of time it took for them to clear it up is a different matter and one that we seem to have no facts on, as of yet.

He might retain someone to look into it for him, but basically right now you can't say that nearly enough is known to tell whether there is something viable there, in terms of a lawsuit.

As a complete aside, that's not an especially attractive beginning to the story, is it? Admitting you were with someone who "searched" a guy and took money, then gave you some for gas and then bought some burgers. And now you are mad because later they lost your community service paperwork. Just saying, its not on the face of it a terribly sympathy-laden situation

Morley should do well in Kiffin's Defense...but only time will tell!!!!

Why do you say that?

My observations have nothing to do with who is right or wrong. Just commenting that I am sure he will have someone look into it and that by happenstance I have some background in the legal issues at work. Like I say, we have very little fact and I'm just commenting on what the general legal issues are in such cases. Nothing novel about that.
