How does this lawsuit affect us?

I have just read the news articles and not much more but it seems people are mad at Hart for all this which could affect his job security. Hope Dooley gets this show on the road and I think he does, but what happens if he doesn't and we are forced to make a change with a AD with his job in question?

It's all hypothetical, but if we did have to make a change in coach it would be hard to get a top coach we need, when we have uncertainty at the top of the AD..


What say you all? I just wish Pat never put her name in this, otherwise it would just be a story for a day or 2 and would be a forgotten story..

It will pass.... Just wait until someone else screws up and makes some headlines....

This type of stuff falls under insurance and will be paid out by them.

We can now offer Gruden both the AD and the Head Coaching job.

Heck, if he can wait until March, he can take over for Cheeks, Hart and Dooley. He can be president, AD and head coach of the Tennessee Vols.

Hire Dooley as AD, in turn he hires gruden as head coach. Everyone is happy, a bammer is without a job, and we will have a big name guy in recruiting. Done.

Has UT even answered the complaint?

From what I can tell right now, there is only a complaint filed, and an affidavit (sworn statement) by CPS. As far as I can tell CPS is not a party to this lawsuit, so all of the chatter about what might have happened to her doesn't matter. Well it matters insofar as the reason it was included in the complaint appears to be a PR measure to attempt to induce UT to settle, prior to trial. I don't even know how CPS's experience (which even in her affidavit apparently claims was a misunderstanding) could effect Jennings positively. It is a strain to make the argument that CPS was fired because of discrimination, CPS isn't suing, but somehow that proves that Jennings was fired because of discrimination. Very weak, in my view.

I would surmise that UT has a team of capable lawyers who are probably drafting an answer that will lay out precisely why Jenning's was fired, prove that it had nothing to do with gender/sexuality, and ask for summary judgment. I doubt the answer will get any media coverage, and that is the real tragedy here.

A complaint is a totally biased interpretation of events (the plaintiff is listing her complaints without any sort of input from the defense). We need to remember that when reviewing these stories and documents.

I would be upset if Pat Summit found it necessary to file a suit. She has "standing." This is a nuisance suit. It will never see the inside of a courtroom.

The UTAD carries gender discrimination insurance? How do you write that policy? :blink:

Usually through a CGL (commercial general liability), however, in Tennessee, an individual cannot hide under the umbrella of a corporation for an act of harassment and can be named as a party to the suit as well. He may be able to be covered under the policy if he can show the person above him encouraged or allowed the behavior.

I was about to say that I thought it would have to be under some liability insurance.

I can't believe it would be written to cover so many employees. A 10 person discrimination lawsuit could run that insurance company out of business once the payouts are done.

Makes you wonder about Penn State how much it will ultimately cost them. No matter what it is it will not be enough!

Usually for such large groups like this, the self insured retention or deductible is pretty damn high (think millions). That's how the insurance company can survive. That and there is usually a cap on damages, and, most often, punitive damages are not covered. Only the compensatory, general, and special damages.

Jennings used her "friendship" with Pat to give her claims some sense of credibility. It will be sad if the University has to defend itself by criticizing Pat. Jennings is a bitter troublemaker and I hope she never sees a dime.

They absolutely have insurance coverage for this gold digging feminest suit. She is trying to use Pat and if you go back and read Tyler's statements it is clear that Pat is not participating. It's a shame but it smells like Maisel's accusations and suit. I am sure Pat gave a deposition but those of us who have run companies, or managed thru this type of alleged discrimination know that it goes to a human rights commission as the first stage. Frankly it is much ado about nothing.(quick buck hunt)
