Freshman daughter busted by City Police- need help on how things work?

19 year old freshman Daughter coming out of bar approached by Knoxville City officer who asked if she had been drinking. She replied yes and was put in handcuffs and into holding cell and never given breathalyzer. Her sister posted bond with court date set for next monday.

I could tell you how things would shake out in my area. Curious how they shake out in Knoxville. Thoughts?

pretty ridiculous to arrest on that but it is the KPD. Get a lawyer to go to court and it's unlikely anything will happen besides a fine

They're a lot more likely to go after the bar that was serving underage people. I would expect no more than a fine or community service for her.

Lawyer make a difference on this? What sort of fine is the range?
I got a stupid public intox in college and got one. Not sure how necessary it is but it was not expensive and he knew what to ask for

I have no idea on the fine though

Will most likely give her diversion. They will allow her to complete an alcohol awareness class. She will take proof back to court and the case will be dismissed

Most likely that's not the whole story. They can't just place someone in cuffs because they answered "yes" to drinking. Did he ask her how old she was first?

Also, as other people said, this isn't a huge deal. She'll get probation and take a class and it will be removed from her record.

If you're really worried you could get a lawyer.

However, this is so common, I would bet that she could show up in court and they will just make her pay court costs and will drop charges after a diversion program/probation.

My first couple years at UT, they just wrote people up for underage. But I think they changed their policy because the last 2 years I was at school they actually started hauling kids off to the county jail for it. What a waste.

reminds me of one of Ron White's stories from "They Call Me "Tater Salad""

he was drunk in a bar and was thrown out onto the street, where he was promptly arrested for public intoxication, "hey, hey, hey!" he said, "I was drunk in a bar, they threw me out in public."

sounds funnier when you listen to it

I know how Ron feels. I was arrested for PI for walking home to avoid driving drunk. Cop told me if I had driven I'd already be home instead of in cuffs

My first couple years at UT, they just wrote people up for underage. But I think they changed their policy because the last 2 years I was at school they actually started hauling kids off to the county jail for it. What a waste.

My first couple of years at UT you couldn't be underage.

Our sports message board ALWAYS instantly begins yelling "TOS" as in violation of Terms of Service for not posting female pics. No daughter pics from this Dad, but if you wish I can post her older brothers pics you lucky boy!

I am leaning toward a short free lawyer consultation, signing her up for the local ASAP and having her request community service in lieu of fine since she has about $3 to her name and tuition was plenty enough.
