Finally these feckless bastards are gonna get drug into a courtroom and we get some sweet discovery on their machines!

That's not how this works. A person doesn't get to simply force unlimited discovery by making completely unfounded, defamatory claims. Powell's team will have to produce some kind of evidence that somehow establishes a prima facie case that the machines were rigged. Her lawyers aren't going to just get to take apart ever single machine used in the election.

Dominion is who filed suit, Powell gets to defend herself so she'll have a lot of leeway in discovery.

If I claim that you have 9 year old sex slaves hidden in the walls of your home, and you sue me for defamation, I don't get to take a sledgehammer to every room in your house.

What a asinine comparison. She will get to examine machines and their programs.

You may not like the analogy, but it is 100% apt. There is no such thing as unlimited discovery. The requesting party has to put forth some kind of legitimate argument that will convince a judge that there is at least a decent likelihood that the discovery will produce evidence. The rules of evidence come down hard on fishing expeditions.

If unlimited discovery were a thing, then defamation laws would be impossible to enforce. Because Person A could say whatever he wants about Person B, and Person B would not be able to sue without opening himself up to having his entire life laid bare. If the defamed were a business, no information could ever possibly remain confidential. That you believe that the system works this way is astounding.

Where did I say she would get "unlimited discovery"?

Or they are just 100% confident their machines weren't rigged

I bet the Super Secret Dominion Conspirators are so dumb they didn't realize that before they filed the lawsuit and now they're gonna have to turn over the Super Secret German Server... if the Army gave it back.

They probably feel pretty confident.

Letting the target of a defamation suit tear apart a bunch of equipment based up nothing more than the target's allegation would fit neatly within the definition. If an unfound allegation gets that kind of discovery, then what limit could ever possibly be applied?

Oh I understand that. Thus far there has been zero pressure to produce anything however.

Regardless right now I’d call this more theater.
