WASHINGTON – The Pentagon's senior judge overseeing terror trials at Guantanamo Bay dropped charges Thursday against an al-Qaida suspect in the 2000 USS Cole bombing, upholding President Barack Obama's order to freeze military tribunals there. The charges against suspected al-Qaida bomber Abd al-Rahim al-Nashiri marked the last active Guantanamo war crimes case.

The legal move by Susan J. Crawford, the top legal authority for military trials at Guantanamo, brings all cases into compliance with Obama's Jan. 22 executive order to halt terrorist court proceedings at the U.S. Navy base in Cuba.

Pentagon spokesman Geoff Morrell said Crawford dismissed the charges against al-Nashiri without prejudice. That means new charges can be brought again later. He will remain in prison for the time being.

"It was her decision, but it reflects the fact that the president has issued an executive order which mandates that the military commissions be halted, pending the outcome of several reviews of our operations down at Guantanamo," Morrell said late Thursday night.

The ruling also gives the White House time to review the legal cases of all 245 terror suspects held there and decide whether they should be prosecuted in the U.S. or released to other nations.

Obama was expected to meet with families of Cole and 9/11 victims at the White House on Friday afternoon to announce the move.

Retired Navy Cmdr. Kirk S. Lippold, the commanding officer of the Cole when it was bombed in Yemen in October 2000, said he will be among family members of Cole and 9/11 victims who are meeting with Obama at the White House on Friday afternoon.

Groups representing victims' families were angered by Obama's order, charging they had waited too long already to see the alleged attackers brought to court.

"I was certainly disappointed with the decision to delay the military commissions process," Lippold, now a defense adviser to Military Families United, said in an interview Thursday night. "We have already waited eight years. Justice delayed is justice denied. We must allow the military commission process to go forward."

Obama orders charges to be dropped against terrorist suspect Abd al-Rahim al-Nashiri, accused mastermind of the USS Cole bombing, by the military commission.

(Notice he waited until Holder was confirmed, and I won't forger Alexander and Corker voted to confirm him either.)

Army Col. James L. Pohl, the chief judge at the Guantanamo Bay war crimes court -- said he would not heed President Obama's request for a 120-day continuance, or delay, in prosecutions of terrorism suspects. Pohl called the president's request "not reasonable" and not "in the interests of justice."

The arraignment of al-Nashiri is scheduled for Monday, February 9.

Asked for reaction to the news, Commander Kirk Lippold (Ret.), former Commander aboard the U.S.S. Cole when it was bombed on October 12, 2000, told ABC News that he was "concerned" about the move.

"For some reason the administration says what's been expressed through the legislature is not sufficient," Lippold said of the military commissions, which he said had "undergone extensive legal and legislative review...They need to allow the process to go forward."

In a way, the President tied his administration's own hands, requiring the dropping of the charges. The executive order President Obama signed on closing the Guantanamo Detention Facilities states that "all proceedings" in the US Military Commissions must be "halted":

"I'm looking forward to hearing what the president has to say tomorrow when he meets with the families of the U.S.S. Cole," Lippold said.

Abd al-Rahim al-Nashiri, the mastermind of the USS Cole bombing and other terrorist attacks, who headed al-Qaeda operations in the Persian Gulf and the Gulf states prior to his capture in November of 2002

Born in Saudi Arabia, al-Nashiri travelled to Afghanistan to participate in attacks against the Russians in the region. In 1996 he travelled to Tajikistan and then Jalalabad, where he first met Osama bin Laden.

Bin Laden attempted to convince al-Nashiri to join al-Qaeda at this point, but he refused because he found the idea of swearing a loyalty oath to bin Laden to be distasteful. Still, after al-Nashiri traveled to Yemen, he began to consider committing terrorist actions against United States interests.

When he returned to Afghanistan in 1997, he again met bin Laden, but again declined to join in the terrorist group. Instead, he fought with the Taliban against the Afghan Northern Alliance.

Still, he assisted in the smuggling of four anti-tank missiles into Saudi Arabia, and helped arrange for a terrorist to get a Yemeni passport. His cousin, Jihad Mohammad Ali al-Makki, was one of the suicide bombers in the 1998 U.S. embassy bombings in Kenya.

In 1998, al-Nashiri joined al-Qaeda, reporting directly to bin Laden. In late 1998, he conceived of a plot to attack a U.S. vessel using a boat full of explosives. Bin Laden personally approved of the plan, and provided money for it.

First, al-Nashiri attempted to attack the USS The Sullivans as a part of the 2000 millennium attack plots, but the boat he used was overloaded with explosives and began to sink.

The next attempt, however, the USS Cole bombing, was successful. 17 U.S. sailors were killed, and many more were injured. This success brought him fame and respect within al-Qaeda, and al-Nashiri became the chief of operations for the Arabian Peninsula. He organized the Limburg tanker bombing in 2002, and he may have planned other attacks as well.

In November 2002, al-Nashiri was captured in the United Arab Emirates. He is currently in American military custody in the Guantanamo Bay detention camp, having previously been held at some secret location. On September 29, 2004, he was sentenced to death in absentia in a Yemeni court for his role in the USS Cole bombing.

Since we are going to shortly be such good buddies with Carter's pals the Castro brothers and the base is in Cuba, why don't we just use Castro Cuban justice and take the little puke al-whatever, outside and blow his freaking little brains up side the wall, hows that for common sense??

Oddly enough the brother of Seaman Cheron Gunn, killed on the USS Cole is recently elected South Carolina Democrat Anton Gunn who is far to the left of Barak Obama.

Recently elected to the SC State House, Gunn was a senior campaign manager of Obama’s campaign and got his start in politics as a leftist.....(drum roll)....community organizer!!!!

I also wonder how the separation of powers works in this case. Perhaps the Executive Branch controls military justice - not sure but it seems to be an exercise in executive power -- something that was roundly criticized when the previous gent used executive orders.

Why don't you open your eyes and see that Obama does not want justice but rather is seeking to find means to release these terrorists in the name of civil rights. This is absolutely wrong and you cannot justify it. Enemy combatants have no place in the American courts. They should be tried by the military and if found guilty they should be executed swiftly.

Obama Hussein can hold them until he can get some ACLU guys to help them out of the jam they got themselves into, maybe they will want to be tried in a sharia court in which they will be praised and rewarded.

The Uniform Code of Military Justice may be and probably is the best legal code ever written.


Judges of the court may be removed from office by the President, upon notice and hearing, for--

(1) neglect of duty;

(2) misconduct; or

(3) mental or physical disability.
A judge may not be removed by the President for any other cause.


The Uniform Code of Military Justice (UCMJ) is a federal law, enacted by Congress. Its provisions are contained in United States Code, Title 10, Chapter 47. Article 36 of the UCMJ allows the President to prescribe rules and procedures to implement the provisions of the UCMJ.

The President does this via the Manual for Courts-Martial (MCM) which is an executive order that contains detailed instructions for implementing military law for the United States Armed Forces.

Obama just needs time to put down his copy of Noam Chompski's latest drivel and study up on how to do his new job.

We held German POWs until the end of the war, I have no problem with holding these guys until jihad freezes over.

I didn't mean to imply in any way who you may or may not have voted for, my counterpoint to your claim the reporter was being dishonest (honestly I didn't see any dishonesty although he may have been using a media tool to stir up controversy), is that the media was dishonest about Obama all during the campaign.

Obama has expressed concerns about the fact that detainees have been held for years without trial.

(that concern being true, why didn't Barry allow the trial vs the Yemeni terrorist to proceed?? It was the only active prosecution ongoing)gs

He has signed an executive order to close the facility within a year while the administration reviews other options for seeing that the detainees get their day in court.


Francis said he was equally concerned that if, as government leaders have repeatedly said, they're seeking justice in the Cole case, why does Yemen retain favored nation status with the United States?
