Federal government didn't recognize gay marriage in any state, so they are not at fault. Does Mass have a state income tax? If so, they should have been able to file jointly under Mass law, I would guess. I fully support gay marriage, but in this instance, the federal law and Mass law were different. A federal return is filed subject to federal law at the time. A Mass state return would be filed under Mass law.
