It can be amended, and I wouldn't even be opposed to that, but not by way of an executive order. It will have to go through the Constitutional Amendment process. Trump can not do this unilaterally, nor should any President be allowed to alter the Constitution with one stroke of a pen. If that executive order is allowed to stand, then the United States Constitution isn't worth the paper its printed on.

No, it was poorly written. It was never, ever meant to include the world's trash to deposit their anchor here. Doesn't matter if you don't like that. As she was due any moment the ships doctor obtained permission from the CO to allow her to birth on board the Coronado. He does have a certified copy of the ships log entry. The Citizenship Clause of the 14th Amendment plainly grants citizenship to all persons born or naturalized in the United States of America, and subject to its jurisdiction. That means that a person born on American soil is granted citizenship of the United States and the state in which they reside, as long as they are subject to prosecution under American law .... which both the child and their parents would be, if they were to ever break the law. For the most part, the only people who birthright citizenship does not apply to, are foreign diplomats. Illegal aliens are prosecuted all the time for violating American law, as they should be. That is part of what makes the 14th Amendment so clear, and your arguing the point so stupid.

In that article, Jonathan Turley gives two significant quotes. First, he says :

"The Supreme Court can, of course, change the interpretation of the 14th Amendment, although I would still say that that is unlikely."

AND THEN, HE SAYS ....

"It's been determined that anybody who is in this country who's not working as a diplomatic attache or something like that, or working diplomatically for an embassy, if they have a child in the United States, that child is an American citizen. This has been the longstanding precedent that the Supreme Court has followed. So it was virtually impossible that the Trump administration could prevail in the lower courts because they would feel bound by case law."

Also, I highly doubt that Harold Ford Jr. argued that the Supreme Court would change the interpretation of the 14th Amendment .... not that his opinion matters.

Harold Ford Jr. is not an attorney. Everyone knows he flunked the bar exam so bad, he couldn't retake it. Bob Corker's campaign made a big issue of that during the 2006 Tennessee Senate race.
