No, they are not at the direction of Congress its at least a fire-able offense and a distinct possibility of criminal liability.

if it falls under one of the executive office agencies, why wouldn't he be able to?

The funds are "appropriated" for whatever task. They aren't "spent" on that task by Congress. basically the President has up to however much money is appropriated to spend on that task. There are very few "minimums" required.

I mentioned on this forum long ago that the U.S. was not only funding 3 of 4 fractions in Syria, but they were further funding terrorist groups in violation of Law. People should be indicted including treason. And you could probably start with the Big Guy.

Actually, this is one of the aspects of this administration that I respect.

I know that what Trump and Musk are finding isn't "magical," they are just using systems and data that haven't been utilized effectively.

For instance, in NC the Medicaid system has used IBM systems nicknamed "FAMS" (Fraud and Abuse Management System). This system can find, for example, a dentist submitting multiple billings for pulling the same tooth from the same patient multiple times. Believe it or not, the NC Medicaid system is set up to pay these multiple billings.

You would think the system would stop it, but it doesn't. It operates under "pay and chase", - pay the claim and chase the fraud after the fact to try to recover the money. The theory is, if providers have to prove a service before being paid, they won't sign up to be Medicaid providers and the recipients would suffer.

Other systems identify providers linked to different companies that operate throughout the state, for instance, mental health providers billing all day in-person services in Asheville the same day they bill all day in-person across the state in Wilmington. Physically impossible, but the system pays it.

What Trump and Musk seem to be trying to do is shut off the spigot when reliable indications of fraud occur, rather than waiting for administrative or judicial action before stopping fraudulent payment.

(And yes, I do know what I am talking about. And no, I am not going to find a receipt from 2006 to try to prove it. IYKYK.)

While its stupid that we are paying this, Congress appropriated the money for this reason. The reason is stupid but it is a legal appropriation of money.



In short, blame Congress...

"Appropriated" does not mean it has to be spent. My first job out of grad school required me to administer the grant I was hired under. I didn't have to spend all that money, and and money I did not spend would have been returned to the funding source at the end of the fiscal year. Of course, that would have made the next year's grant smaller, rather than same/larger, so my superiors made sure I spend all the grant money by the end of the year. Lots of new pens, paper and copier contracts! Yeah!

If you want to change it, pass an appropriations bill that guts this type of wasteful spending....

He absolutely has that duty if he knows, suspects and is in the process of auditing said activity especially for criminal conduct. What you are saying is that executive branch can't stop criminal activity within the executive realm, its not only legal its their duty. Actually, if you look at what Biden did with EV and internet funding that is exactly what they did.... they did not do what Congress allocated as far as spending and execution.

So, the FBI goes to your house and willful murders you and your family in cold blood (with a plan) and just because the funding they used was authorized by Congress the President and the executive branch can't stop the criminal activity from occurring but can't stop payment? What you are suggestion is not only idiotic but goes against the whole freaking Constitution.

Now go back to hating all your fellow Americans. I can only hope you haven't reproduced.
