Since you are reluctant, I'll answer my own question. I do not think their response decisions are color blind. I do believe they are more color blind than they were 50 years ago. Progress has been made but it has been far to slow and more is needed.

I am not sure it gives it anymore power. Such a law would simply be ruled unconstitutional by this court.

Because they are reluctant to set a precedent of having rights to medical procedures become something that needs to be individually codified.
