Texas Soldier who Shot Protester Indicted on Murder Charge

An Army soldier who shot and killed an armed protester after driving into a crowd demonstrating against police violence in the Texas capital last summer has been indicted on a murder charge, authorities said Thursday.

Sgt. Daniel Perry, who was stationed at Fort Hood, was booked and released on $300,000 bail, said Kristen Dark, a spokeswoman for the Travis County Sheriff's Office.

Perry’s attorney, Clint Broden, has said the soldier was working for a ride-sharing company and acted in self-defense after Foster pointed a gun at him. Broden issued a statement Thursday expressing disappointment in the indictment and confidence that Perry would be acquitted.

We are seeing an unprecedented movement in this country by politicians and DAs to destroy a person’s ability to defend themselves against criminals. Your property and life mean nothing to them.

Someone needs to start holding them accountable.
 
I feel like there were videos or picture released shortly after this incident that did show the protestor pointing his rifle at cars.

Witnesses @ scene stated Foster was not pointing the weapon at the driver. Even if this is what took place, Foster had no authority to stop the vehicle and demand the driver lower his window.

Not even about that IMO. Removes all potential chaos scenario so they can shove this Eurocrap down our throat.

The witnesses might not be credible as they were protestors blocking the road. I feel like I remember a much more menacing photo/video of the guy with the rifle that made the shooting justified.

Minor detail, but the military.com article makes it sound like the car was stopped before Foster approached, not that foster stopped the car. I don’t know enough about this to say who is right or wrong, and it sounds like there are conflicting reports on whether he pointed the gun or not, but when open carry is legal, you shouldn't be able to rely on the mere existence of a gun for self-defense.

Existence of a weapon and not engaging is one thing. Walking up to an unknown vehicle, with a majority of your face concealed, with your weapon shouldered as in the photo, was a mistake that cost him his life. Who knows if he had his finger on the trigger and if so, all bets are off at that point. Foster was careless and shares a significant amount of responsibility for this incident.

We don't know a lot of things about this incident. That's a standard way to carry a rifle especially if it's on a strap and I've seen it used by "peaceful protesters" at rallies for a multitude of ideological issues. Each is going to be a case by case basis and the "he had a gun" excuse shouldn't cut it if you're a 2a guy.

I’m a 2a guy and he has the right to be there but never should have walked up on a car of someone he didn’t know.

I think we're going to be case by case all day long. Did dead guy feel threatened because other dude drove into the crowd and that caused him to partially shoulder his gun? Its a vicious cycle.
In this case there is a video of dead guy doing an interview calling people he disagrees with pussies just a few minutes before the incident. 2- he’s not law enforcement. He’s not trapped. He’s advancing on the car and taps on the window. The first report was he did so with the barrel till the witnesses changed their story.

A weapon is for self defense. The car was stopped and nobody was in danger. In that situation there’s absolutely no way I approach the car especially with the gun in view. Regardless of how this shakes out the dead guy made a big mistake and did what every self defense class teaches you not to do in the very first class and he paid with his life

edit: the context on the video is….he was asked if he was worried about walking around with an AK47 and what might happen. He said “nothing is going to happen because they’re all a bunch of pussies”

I haven't seen the video. Lots of states have no duty to retreat, but there's also no prohibition to approach. I contend carrying a long rifle in public is inviting trouble and its going to be a contentious case by case basis.

I don’t know what the law is there.
I do know that I’ve been to enough classes that I would not have gotten shot that night

Governor Abbott needs to just go ahead and announce that there will be a pardon if he is convicted

Travis county DA, Jose Garza, is apparently trying to make an example of the driver. Considering how blue Austin is, there's a strong possibility he's convicted. In just about every other county in Texas (with the exception of Harris county), this guy walks.

You can’t point a gun at a guy for no reason
