I’m not a lawyer but like many others I often wonder how can our guys get out of the trouble that they get themselves into. Well I think it’s called diversion. I think as long as you are a first time offender you can take advantage of the diversion provision in Tennessee statutes. jmo.
I think the way this works is you plead guilty to whatever is worked out for you to plead guilty to and upon sentencing you go straight to probation for I think 11 months and 29 days. This is for Tennessee. jmo.
I think the alleged horrific animal cruelty story we reading about with Aaron is at most a Class E felony and if he doesn’t have a history he should be eligible for diversion. jmo.
The other guys currently suspended I think are also eligible for diversion, assuming first time offenses and simple possession and paraphernalia , in the state of Tennessee. jmo.
This is my understanding of the legal issue/process. The university’s processes are I think apart from the law enforcement processes so that’s not something I can research. The optics of animal cruelty I think are cringe worthy so I don’t know how the university deals with that. Drugs shouldn’t be a big issue, nowadays. jmo.
I’m tentatively expecting all of our guys back once all the processes have run their course and the guys have issued public apologies. The diversion avenue, available to anyone in the state of Tennessee that qualifies, hopefully gives them a chance to learn from their mistake so they can be better citizens going forward. jmo.
edit to add - as I understand the diversion process, if the kids complete their probation successfully, i.e., no additional run-ins with the law, then at the end of the probationary period there is a process where they can go back to the court and request that their record be expunged. jmo.
