In NY if your employee gets sick, has a stroke/heart attack on the job it falls on WC. If the employee is not based in NY but there on business and any of the above happens in the hotel room it falls on WC. I hate NY almost as much as TX.
As for a potential lawsuit? I’m sure there are lawyers chomping at the bit waiting to file on cases like that.
