It varies according to local rules and practice. I'm not an expert on Alabama. But in a lot of places the service of a motion to quash abates the date and nothing happens until the party wishing to take the deposition sets a hearing.

And yes, you are right on the usual basis for a motion to quash. I don't know what grounds they raised. It might also have been joined with a motion for a protective order seeking to limit the time or scope, or require it to be taken in Knoxville, etc.

maybe i just took offense to it because you quoted me, but again you haven't really listed anything i didn't already say, so i'm guessing he's not getting served again. Unless he loses a dance contest...

and since they haven't done anything about the attempt to quash it, he's not talking on thursday in court either.

There would be no reason to serve him again in connection with the deposition the other side wanted. And you are right- no deposition this week because there's been no ruling on the motion to quash. And depositions are normally given in one of the lawyer's conference rooms, not in court.

I think the guys are in cahoots trying to rehash all this stuff should be sued themselves. I did a little background search on the lead attorney and he didn't even go to law school until he reached age 32. Not that that in itself is bad, but how experienced is he. He's just wanting free publicity/advertising and is another idiot attorney that wants to try and tie the courts up needlessly. He is kind of attorney that makes others look bad unfortunately for honest hardworking ones.

haven't read up on the guy to say anything else about him, but early 30's, while on the high end of the age range in my class, was not unusual. you see a lot more of it these days. more career switchers when the economy is bad turn to law school, because it buys you time and there are no specific educational prerequisites (other than a bachelors degree).

The only thing fulmer will be served in Auburn is a ton of food---he loves the ribs down there.

lol, I thought your post was refferring to him get served as coach by Tommy Bowden.

i too am looking for an explanation for this.

I know Tommy Bowden is the coach at Clemson

His brother Terry once coached at Auburn, even had an undefeated season. Terry also likes to play with coeds.

Both Terry and Tommy have the same father, football coaching legend Bobby Bowden.

That's what I know (other than going more in depth of each coach's careers). I, like ksusha, have no idea what gainesvol is referring to.
