Did victim reach at/in pockets after he shoved him down?

Doesn't appear to. Looks like he adjusts his shirt, but his hands are still clearly visible immediately after and he's even raised them slightly right before the shot.
 
Murder.

Sorry LG, but the State won't have a hard time proving there was no threat for serious bodily harm or death in this one. A shove doesn't equal the application of deadly force. Guy was backing up and clearly not a threat at the time of the shooting.

This guy gives lawful gun owners and CCW carriers a bad rap as Ras stated.

Yep. The guy had the right to pull his gun. He didn't have the right to pull the trigger.

If that's how it's seen, the shooter may likely serve time IMO...admit I don't know the law(s) that could tie into this matter.
 
WTF is wrong with Sheriffs in Florida?

Sheriffs are an elected position. Going out on a limb by saying that it's a career limiting move to arrest a white dude who was assaulted by a black guy for utilizing his right to stand his ground.

That's my take on the reality of it.

My personal opinion is that this dude should be charged with murder. Deadly force was clearly not warranted.

I looked it up. He won with 77% of the vote in the last election.

Not sure he's worried about a "career limiting" move. Well, now maybe.

Guy should be rotting in jail and goes free.
I am not saying he doesn't belong in jail. Never did. I am not justifying what he did. But the question is whether or not the 'threat' the shooter presented was enough to warrant physicality. I 'saw' nothing other than verbal assault. The shooter didn't put hands on the other man's wife. And then the other man shoved the shooter. That was the escalation from what I saw on the video. Did the man deserve to die for that? Undoubtedly not.

But the other question in my mind is why did the one man hit the other one? My guess is because he saw a weaker opponent. He probably wouldn't have hit someone that was Shaq size. That was my only point in the whole thing.

If you come away from this only pointing the finger at one individual, then you are clueless.

Wouldn't have happened to me. I wouldn't have opened my mouth to someone parking in a handicap space. I have seen it many times, and kept my mouth shut. I also wouldn't blindside somebody right off the bat. 2 dumbasses with short fuses, and one of them is dead. Too bad.

I think producing the firearm was wholly a justified reaction. Not only was the shooter blindsided with force the shootee absolutely appeared to be closing after shoving the person to the ground. I've no issues with weapon presentation at this point.

However

The shootee took at least three steps in direct retreat and started another step to turn away before the shots were fired.

Not only should this guy get burned to the ground but I'd like this video (and hopefully maybe a clip of his ass being declared guilty in court) in every carry class in the country about what not to do and what is not justified.

I broke my leg skiing a few year ago and was on crutches for six months. I'd never noticed how pervasive it was before that, let me tell you - it happens ALL the time and it's infuriating for the people that genuinely need it.

Not as infuriating as people taking govt benefits when they don't deserve them.

Look at our board. Being all objective and grown up. Finding agreement on a white guy in the wrong for killing a black man. Calling into question his temperament to even have a CCW.

I’ve stayed out of this whole -who’s right/wrong?- mantra, and purposefully so, but plenty of blame can be cast for all involved.

Simply put, you don’t always know who you’re forking with, so it’d be better for everyone to STHU and go on about their business. If the “hero” didn’t use unnecessary force, I’d guess with 99.9%+ certainty, he’d still be alive.

Being a “badass” for lil’ momma has a price. He paid for it with an ego, in exchange for a pine box nap.

Let the legal system figure it out. My guess, he will get manslaughter, at most.

Regrettable situation. I have to say that I agree with nearly all I have seen posted. Dude needs jailtime...but don't put your hands on people, don't get shot. That simple. I feel like he murdered the assailant, no doubt. I also feel like anybody who makes things physical, blindside like a puss mind you, with an 80 year old man in this day and age is asking for big trouble...sad situation.

It does lead to questions unanswered.

What was the shooter saying to the woman in the car? She got out for a reason after a (somewhat) extended conversation in the car. Other than the guy being a dickbag over her parking there (notice he wasn't in a parking spot either) what transpired to get her out of the car?

Did the victim (yeah, he's a victim) overhear something that caused that reaction? If a man told my significant other he was going to beat the crap out of her for parking in a handicapped spot, I'd surely take issue with it. Probably not to the physical level, but you'd bet I'm getting between him and my family.

Did the victim say anything else after backing off? "I'm going to eff you up" could be perceived as a threat even if he wasn't moving.

This guy (seems to be a recurring theme these days) was on the radar with possibly violent encounters before. It seems rather odd the Sheriff dismisses his previous encounters as "not being relevant." Sure seems relevant now.

He blindsided him and I'm not going to call that one a "violent" anything. It's not like he ran into him. He walked up and shoved him. No punches, no kicks, no running start. Just a shove from a standing position.
I wondered the same thing.
