But you're dead wrong about the rule book. You contact a recruit and encourage him to go to a specific university, and you are by definition a booster.
Now, that doesn't mean the university is automatically in trouble. The NCAA investigates, and if they find out that some yahoo named Bearcat in Tennessee did it as a lark, to try to get Bama in recruiting trouble, they'll close the investigation with no harm, no foul.
But in this rumored case, Gruden could hardly come off as some yahoo just fooling around.
