If they are going to stick with this, then they should probably include actual countries that terrorists attacked the US from. And they should drop the religious test, it is a non-starter. American citizens will be involved in this, so the moment they insert religion into it, it will not happen.

The left has always cared about the Constitution, I'm not sure why you think this a dig. You use that now as an insult even though Trump has obviously overstepped his bounds and is being called on it. The same would have happened to Obama if he overstepped his bounds. Trump's own Supreme Court nominee is voicing dissent against him. That is how it should be. Independent courts.

You are correct. SCOTUS tie would result in 9th Circuit ruling stands. For those in denial, see SCOTUS tie on Obama immigration EO in (I think) 2015.

It is very simple. All The Donald has to do is amend the EO. He doesn't even have to rewrite it. This should not be about "winning", it should be about getting it right. He needs to grow the f*** up and quit acting like an impetulant child.

The POTUS probably does have the power to ban refugees, no matter the reason...however, it is unlawful to discriminate against immigrants based on nationality, which the EO does

I've seen conflicting reports on this but if the EO only bans those outside of the US and with no citizenship or visa, then they have no rights under the constitution

The EO as written is very unconstitutional. You can't deny people who already have visas due process. Carve that out and he is good to go:

Where do you justify nationality being illegal? Please show me where that law exists.

Trump's modus operandi is to never admit a mistake or apologize. He has already said that he wanted to wait a month to roll out this executive order but 'was told no'. He takes accountability for nothing which goes awry. Withdrawing this order and replacing it, would be backtracking in his eyes and he would never do that. 'Winning' is what matters. The EO as written, is what the Trump team is going to have to defend.

The law specifically says that the president can restrict ANY type of alien from entering the country temporarily when deemed in the best interest of the country

It's been legal precedent for 50 years that you can't discriminate/make quotas based on nationality. I cited it a few times early ITT. I am mobile and don't feel like digging it up

If Trump is really concerned about the safety of US citizens, why not temporarily ban immigration of Syrian refugees, and severely vet anyone, US citizen or not, that has recently visited a country that is considered a hotbed of terrorist training, such as Syria, Pakistan and Afghanistan.

I also see a problem with immigrants that come to the US that don't love our country, with no intention of assimilating into the culture and persuing the American dream.

I agree and it is disconcerting that we have such an immature, vindictive and unprepared person as President. I've fired managers for less. I'm thinking a 5 year show cause for lack of instutional control and stupidity is in order.

The ban has already stopped the influx of terrorists disguised as refugees. These guys are their most precious resource, takes years to create 1. Would you put them on an airplane right now?
