Haven't followed this situation closely but doesn't the State have option to pick up case even if accuser didn't press charges bc of type of crime? I know assualt and sex crimes are that way in Florida.
It was discussed that the charges may have been dropped at the county level (General Sessions in TN). If the DA agreed to do that, then it almost always never gets indicted (as in, "state picking it up"). There are very few circumstances where the DA can make the decision to dismiss and then indict it. If that occurred to get around a preliminary hearing, then it's basically prosecutorial misconduct.
