Coleman Thomas Arrested - charges dropped 4/15

Has any new evidence surfaced to back up Coleman's claim that he was just selling it for a friend? Hopefully the kid wasn't dumb enough to personally steal it, then sale it himself. Even if he did know it was stolen, that would be extremely hard to prove. As long as he didn't personally steal it, I'd bet all charges will be dropped. Look for him to rejoin the team soon.
 
1. You should be able to get a copy of the security tape as well as campus security and/or local police reports, using a Tennessee Open Records Act request (this is the state version of the federal Freedom of Information Act). Both public university and local police jurisdictions are subject to the law, I believe. Google the act name for an example of a request.

2. For criminal proceedings against the alleged thief, you'll have to let the police do their job. Be patient.

3. If you want to sue the guy in civil court to try to get your property back, or to be compensated for its loss, you're free to do that. You'll probably need a lawyer, which means you're probably going to put into play a lot more money than the value of your ps4. You could get it all back, including the lawyer fees, eventually. But it's still a gamble to some extent.

4. If you have personal property insurance, it may cover loss to theft. You'll have to check your policy. If you don't, might want to look into it. Though, for small claims like this, the deductible may be as large as the loss, so not worth claiming.

And to caveat all this -- I'm not a lawyer, just a guy who has been around the block a few times. If you're serious about #3, you really need to get hold of an actual lawyer.

Hey man, thanks a lot! I am going to go for option #1 first lol. I am going to find out who it is, because I'm pretty sure I know the guy and have played 2k with him before. I'm going to bluff and tell him I am going to sue him for all he is worth unless I get my playstation back. Also, is there a chance that the police might not get back with me at all?

Just wow. You also understand the intent of the law you cited right? Very shortened version, to curb theft by curbing the "fence", or pawn shops etc.. that willingly take suspicious merchandise. Like the steel recycling companies accepting public works man hole covers.

It was not created to punish naïve or even stupid kids. If you can research the laws, then please research the debates that preceded and the intent.
spirit of the law has no bearing in a courtroom. thats for talk shows. there are a lot of laws that were passed for one reason only to be abused by overzealous DA's. A good example is terroristic threats and child endangeement. I ran into quite a few guys with those charges that carry serious time for ridiculous reasons.

If they find your property, they'll get back to you for sure. Barring that, their focus is on solving the crime, not keeping you updated. You can check in with them once every couple of weeks if you like, but try not to bug them more often than that if you can help it.

I don't believe attorneys fees would be recoverable in this instance. If they are, it will be included by statute and that is unlikely (not impossible but unlikely).
 
Irrelevant. Thomas didn't have to personally steal the Xbox from the dorm room to be guilty of theft; it's enough that he received property he knew or should have known was stolen and didn't report it to the police. T.C.A. §§ 39-14-101, -103. The fact that Thomas sold away the Xbox at a Game Stop store on the SAME AFTERNOON it was stolen is extremely suspicious. Even if somebody else physically stole the property, who drops everything they're doing and immediately sells $640 worth of video game merchandise for pennies on the dollar ($176) on behalf of somebody else so far away from the university? I think Thomas knew EXACTLY what he was doing, but even if he didn't, that level of stupidity is still criminal if a prosecutor can prove willful ignorance.

Coleman, if this is you, what the hell were you thinking? If you think you're coming back before the end of spring practice, I don't think you appreciate the depth of the sh*t you've gotten yourself stuck in.
hey he didn't kill anybody. Not saying he didn't do wrong, but damn you're all worked up over as you said, pennies on the dollar. Calm down and let Jones handle.
 
I don't think Thomas is coming back. Assuming he isn't, who's our backup center? Is anybody else seriously capable of pushing Crowder for a starting job?

Everyone deserves a second chance for being a dumbass and I love versatile offensive linemen but I detest thieves. Very conflicted here. Damn Coleman why man?

Has any recent news made this thread shift the other direction. OH hearing it should be cleared up soon to kid not expected to come back. I am :crazy::banghead2::mega_shok:

Lots of chatter on Coleman Thomas and the chance for good news there this week, sooner than later. Thomas has remained in steady contact with the coaches, specifically Butch Jones, and is taking the necessary steps to rejoin the team as soon as possible. He's remained working out and also spent time with his teammates as much as possible, including Saturday morning before the Vols' work inside Neyland Stadium.

sounds like Thomas be back next practice.. expect him at center pushing Crowder
